ORDINANCE NO. 2579
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
VACATING A TEN FOOT (10') WIDE ALLEY LOCATED
SOUTH OF 182ND STREET WEST AND EAST OF 81ST
AVENUE WEST, AS SHOWN ON THE FIRST ADDITION TO
THE CITY OF EDMONDS, DEDICATED FOR STREET
PURPOSES AND PROVIDING FOR THE FULFILLMENT
OF CERTAIN CONDITIONS.
WHEREAS, pursuant to the petition of the abutting
property owners and following review and recommendation of its
Hearing Examiner, the City Council of the City of Edmonds held a
public hearing on July 1, 1986 to consider the proposed vacation
of a certain unimproved alleyway in the City of Edmonds,
Washington, dedicated for street purposes in the First Addition
to Edmonds 1890, south of 182nd Street and east of 81st Avenue
West, as shown on the First Addition to the City of Edmonds, more
particularly described as set forth on Exhibit A, attached hereto
and incorporated by reference as fully as if herein set forth,
and
WHEREAS, pursuant to the finding of the City's
Responsible Official, the City Council finds that there will be
no significant adverse environmental impacts, and
WHEREAS, at the conclusion of said public hearing, the
City Council found that said property dedicated for street
purposes should be vacated upon the satisfaction of two
conditions, to wit:
a) The payment of the costs associated with the
review of the Edmonds Hearing Examiner; and
b) Satisfactory completion of the subdivision process
with respect to abutting properties.
WHEREAS, the staff has notified the Council of the
approval of said plat for abutting properties and receipt of the
costs associated with said Hearing Examiner's decision, the City
Council does hereby determine to vacate the same as hereinafter
set forth, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The following ten foot by two hundred
twenty-five foot (10' x 2251) parcel of property previously
dedicated for street purposes is hereby vacated subject to the
City's reservation of an easement to construct, repair and
maintain underground public utilities. Said parcel is located in
the City of Edmonds, Snohomish County, Washington, south of 182nd
Street west and east of 81st Avenue West, as shown on the First
Addition to the City of Edmonds, as legally described and shown
on Exhibit A hereto which is incorporated by reference as fully
as if herein set forth.
Section 2. The City Clerk is hereby directed to file a
certified copy of this ordinance with the Snohomish County
Auditor upon, but only upon notification of subdivision of the
abutting property and receipt of full payment of the costs of
Hearing Examiner review.
Section 3. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
