AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTIONS 5.16.010 THROUGH 5.16.030 OF THE
EDMONDS CITY CODE ESTABLISHING CURFEW HOURS WITH
RESPECT TO MINORS WITHIN SAID CITY, PRESCRIBING
PENALTIES AND ESTABLISHING AN EFFECTIVE DATE OF
SAID ORDINANCE.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.16.010 of the Edmonds City Code is
hereby amended to read as follows:
5.16.010 Loitering of Minors Prohibited. It
shall be unlawful for any minor under the age
of eighteen years to loiter, idle, wander,
drive, ride, stroll, or play in or upon the
public streets, highways, roads, alleys, parks,
playgrounds, wharves, docks or other public
grounds, public places and/or other public
buildings, places of amusement and entertain-
ment, vacant lots or other unsupervised places,
between the hours of eleven p.m. and six a.m.
of the following day, Pacific Time Zone time;
provided, however, that the provisions of this
section do not apply to a minor accompanied
by his or her parent guardian, or other adult
person having the care and custody of the minor,
or where the minor is upon an emergency errand
or legitimate business directed by his or her
parent, guardian, or other adult person having
the care and custody of the minor. Each viola-
tion of this section shall constitute a separate
offense.
Section 2. Section 5.16.020 of the Edmonds City Code is
hereby amended to read as follows:
5.16.0.20 Responsibility of parents. It shall
be unlawful for the parent, guardian, or other
adult person having the care and custody of a
minor under the age of eighteen years, to know-
ingly permit such minor to loiter, idle, wander,
drive, ride, stroll or play in or upon the public
streets, highways, roads, alleys, parks, play-
grounds, wharves, docks, or other public grounds,
public places and public buildings, places of
amusement and entertainment, vacant lots or
unsupervised places, between the hours of eleven
p.m. and six a.m. of the following day, Pacific
Time Zone time; provided, however, that the

provisions of this section do not apply when the
minor is accompanied by his or her parent, guard-
ian, or other adult person having the care and
custody of the minor, or where the minor is upon
an emergency errand or legitimate business directed
by his or her parent, guardian, or other adult
person having the care and custody of the minor.
Each violation of the provisions of this section
shall constitute a separate offense.
Section 3. Section 5.16.030 of the Edmonds City Code is
hereby amended to read as follows:
5.16.030 Penalties for violations. Any minor
violating the provisions of Section 5.16.010 shall
be dealt with in accordance with the juvenile
court law and procedure and if remanded for pro-
secution shall be subject to the penalties as
enumerated in Section 5.12.170 of the Edmonds
City Code. Any parent, guardian, or other adult
person having the care and custody of a minor
violating Section 5.16.020 shall be subject to
the penalties provided in Section 5.12.170 of
the Edmonds City Code.
Section 4. This ordinance shall take effect five days
after the date of first publication in the official newspaper
of the City.
