AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.13.210 (C), OF THE EDMONDS
CITY CODE ESTABLISHING A MINIMUM SETBACK REQUIRE-
MENT IN THE BC ZONE ABUTTING THE RIGHT-OF-WAY
OF U.S. HIGHWAY 99 AND LAKE BALLINGER WAY AS
RECOMMENDED IN PLANNING COMMISSION RESOLUTION 412.
WHEREAS, the City Council of the City of Edmonds, Wash-
ington, pursuant to Planning Commission Resolution No. 412,
called a public hearing, and having determined it to be in the
best interests and the public health, safety and welfare to
amend the Edmonds Zoning Ordinance as set forth below, pursuant
to Planning Commission Resolution No. 412, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Subsection 12.13.210 (C) of the Edmonds City
Code, setting forth the minimum setback requirements in Commer-
cial Business (BC) Zoning Districts is hereby amended to read
as follows:
(C) MINIMUM SETBACK REQUIREMENTS:
ATTEST:
(1) Rear yards, where abutting on RS classified
property shall not be less than 20 feet in
depth, measured from rear property line to
rear of structure.
(2) The minimum setback requirement from the
roadway right-of-way line for those properties
abutting the right-of-way of U.S. Highway 99
and Lake Ballinger Way shall be 40 feet from
either of said designated roadways, provided,
however, the setback line from Ballinger Way
for properties lying East of the Snohomish
County Public Utilities District No. 1 right-
of-way shall be the extension of the setback
line as established by setting back 40 feet
from the highway right-of-way line immediately
West of the PUD right-of-way.
