ORDINANCE NO. 2594
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
PROVIDING FOR THE ACQUISITION OF CERTAIN REAL PROPERTY
FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING STREET
AND UTILITY IMPROVEMENTS ALONG A PORTION OF 220th STREET
S.W., TOGETHER WITH ALL APPURTENANCES AND RELATED WORK
NECESSARY TO MAKE A COMPLETE IMPROVEMENT IN ACCORDANCE
WITH APPLICABLE CITY STANDARDS ALL WITHIN THE CITY OF
EDMONDS, PROVIDING FOR THE CONDEMNATION, APPROPRIATION,
TAKING AND DAMAGING OF LAND OR OTHER PROPERTY NECESSARY
THEREFORE; DIRECTING THE CITY ATTORNEY TO PROSECUTE THE
APPROPRIATE ACTION AND PROCEEDINGS IN THE MANNER
PROVIDED BY LAW FOR SAID CONDEMNATIONS.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The public health, safety, necessity and
convenience demand that street improvements, including paved
surface, sidewalks, curbs, gutters, storm drainage, landscaping,
traffic signalization, wiring and traffic channelization, be
constructed and maintained on 220th Street S. W. within the City
of Edmonds and that certain property be condemned, appropriated,
taken and damaged for the construction of said improvements as
provided by this ordinance.
Section 2. The City Council of the City of Edmonds, after
hearing the report of the City Staff, and reviewing the planned
improvements, hereby declares that the property hereinafter set
forth is necessary for public use.
Section 3. The property within the City of Eamonas,
Snohomish County, Washington which has been designated on Exhibit
- 1 -
A attached hereto and which is incorporated herein by this
reference, shall be, and the same hereby is condemned,
appropriated, taken and damaged for the purposes of improving and
widening a portion of 220th Street S. W. by constructing standard
curbs, gutters and sidewalks, driveways across sidewalks, paving
the streets, installing storm drainage facilities, traffic
channelization, signalization and landscaping, together with all
necessary appurtenances and related work to make a complete
improvement in accordance with City standards all within the City
limits, together with temporary easements to enable construction
of said improvements, said land and easements being taken, damaged
and appropriated subject to the making or paying of just
compensation to the owners thereof in the manner provided by law.
Section 4. The City attorney is hereby authorized and
directed to begin and prosecute the proceedings provided by law to
condemn, take and appropriate the property rights necessary to
carry out the provisions of this ordinance, and is further
authorized in conducting said condemnation proceedings and for the
purpose of minimizing damages, to stipulate as to the use of the
property hereby authorized to be condemned and appropriated and as
to the reservation of any right of use to any owner, provided that
such reservation does not interfere with the use of said property
by the City as provided in this ordinance. The City attorney is
further authorized to adjust the location and/or width of any of
the property herein described in order to minimize damages,

provided that said adjustments do not interfere with the use of
said property by the City as provided in this ordinance.
Section 5. The entire cost of the property acquisition
authorized by this ordinance, including all costs and expenses of
condemnation proceedings, shall be paid from the City's general
fund.
Section 6. This ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
its passage and publication as provided by law.

25, records of Snohomish County, Washington, described as follows:
Commencing at the intersection of the South line of said
tract with the westerly margin of State Route 99; thence West
along said line 110.00 feet to the Point of Beginning; thence
South 87051107" East along said line for 99.69 feet; thence North
2008153" East for 4.00 feet to the beginning of a curve the radius
point of which bears North 20 08153" East for a distance of 13.00
feet; thence easterly and northerly along the arc of said curve
through a central angle of 650 09'30" for an arc distance of 14.78
feet; thence South 63000137" East for 3.50 feet to said westerly
margin of State Route 99; thence North 260 59'23" East along said
westerly margin a distance of 41.55 feet to a beginning of a curve

of 49.00 feet; thence southerly and westerly along the arc of said
curve through a central angle of 420 13'06" for an arc distance of
36.11 feet; thence North 320 23'14" West a distance of 2.52 feet;
thence South 590 58'38" West a distance of 3.84 feet; thence South
27039130" East a distance of 2.52 feet to the beginning of a curve
the radius point of which bears North 270 39' 30" West a distance
of 49.00 feet; thence southerly and westerly along the arc of said
curve through a central angle of 290 48123" for an arc distance of
25.49 feet; thence North 870 51'07" West parallel with the
northerly right-of-way line of 220th Street Southwest a distance
of 79.79 feet; thence South 260 59'23" West a distance of 11.02
feet to the Point of Beginning.
