ORDINANCE 2606
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING ECC 5.05.020 RELATING TO DOG LICENSING,
PARAGRAPH (C) RELATING TO LICENSE TAGS ISSUED
AND FEES BY THE ADDITION OF A NEW SUBPARAGRAPH
(3) RELATING TO PREVIOUSLY ISSUED PERMANENT
LICENSES, DECLARING AN EMERGENCY, AND FIXING A
TIME WHEN THE SAME SHALL BECOME EFFECTIVE
WHEREAS, the City Council on December 16, 1986 enacted
Ordinance No. 2595 which deleted prior provisions relating to
permanent licensing and required the issuance of an annual license
tags to spayed female and neutered male dogs, and
WHEREAS, the City Council finds that it is in the best
interest of the public welfare to recognize these prior issuances of
"permanent" tags and thereby increase the public confidence in its
regulatory processes, and
WHEREAS, due to the expiration date of prior licenses, the
Council finds that the passage of this ordinance constitutes an
emergency in order to protect the public health, safety and welfare,
NOW, THEREFORE,
FOLLOWS:
THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS
Section 1. ECC Section 5.05.020 Dog Licensing, Paragraph
(C) License Tags Issues and Fees, is hereby amended by the addition
of a new subparagraph 3 relating to prior issuances of permanent
tags to read as follows:
5.05.020 DOG LICENSING.

3. Provided, however, that no owner of an animal
previously licensed for which a "permanent" license
has been issued under the provisions of ECC
5.05.020 is the same existed prior to December 16,
1986 shall be required to relicense or review said
license for such animal. The burden of proof in
establishing the issuance of such license to the
subject dog in any prosecution or other abatement
proceeding under this ordinance for failure to
obtain a valid license shall be on the owner.
Nothing herein shall be interpreted as creating a
defense when such animal fails to exhibit a metal
identification tag showing proof of such license.
Section 2. The City Council hereby declares that an
emergency exists necessitating that this ordinance take effect
immediately upon passage by unanimous vote of the members of the
City Council.
