ORDINANCE 2611
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE PROVISIONS OF ECDC 19.75.175 SMOKE
DETECTORS TO ESTABLISH THAT THESE REQUIREMENTS
ARE SEPARATE LIFE AND SAFETY REGULATORY
PROVISIONS OF THE EDMONDS COMMUNITY DEVELOPMENT
CODE AND FIXING THE DATE WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, any amendments to the Uniform Fire Code, Uniform
Building Code or other such codes which purport to amend the
provisions of the Uniform Fire Code, Uniform Building Code and other
Uniform Codes required by state law to be adopted by the City when
the same affect residential structures of four or more units, and
WHEREAS, the City Council has previously enacted smoke
detector requirements for all multi -family residential buildings,
whether existing or new, which contain three or more units, and
WHEREAS, said provisions were enacted under the City
governmental power as life safety requirements and not as amendments
to the Uniform Fire and Building Code, NOW, THEREFORE, THE CITY
COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. ECDC 19.75.175 Smoke Detectors, is hereby
amended to read as follows:
19.75.175 SMOKE DETECTORS.
A. Residential Buildings.
1. All multi -family residential buildings, whether
existing or new, containing three or more units,
including but not limited to, apartment buildings,
condominiums, hotels and motels, whether or not such
buildings have kitchen facilities, shall have smoke
detection and a fire alarm systems installed which
comply with Section 212-10 Washington Administrative

Code, and when applicable, Section 10.307 of the 1985
Addition to the Uniform Fire Code, previously adopted
by this chapter. Installation of such devices shall in
all respect comply with the provisions of the Uniform
Building Code as adopted.
2. Sounding devices shall be installed on each floor
of each multi -family residential buildings so that they
are audible in all common areas of the building.
Sounding devices must be audible in each room of every
dwelling unit and at least one such device shall be
installed in each unit unless an acceptable alternative
is approved by the Police Chief. To be audible within
the meaning of this section, the required sound level,
when measured in each room of any dwelling unit or in
any every portion of the common area, shall be at least
15 decibels above the ambient noise level and in no
event less than 60 decibels.
B. Commercial buildings shall comply with the requirements
outlined in the Life Safety Code in Uniform Fire Code
as previously adopted by reference by this chapter.
C. Approved Detectors. Any device which may be installed
which is designed and intended for the purpose of
detecting products of combustion and bears the mark or
stamp of Underwriters Laboratory or other nationally
recognized testing laboratory. Battery or AC powered
models, and photoelectric or ionization types are
equally acceptable.
D. Maintenance.
1. The owner shall maintain installed detectors in
accordance with the manufacturer's instructions, and
shall post written operating instructions for each
installed smoke detector to the occupant(s) of a non -
owner occupied building or unit.
2. The occupant shall notify the owner of the need to
repair or replace the battery of any smoke detector in
a non -owner occupied building.
3. This section shall create no liability from the
consequences of any unauthorized tampering or repair
which renders the smoke detector inoperable.
E. These requirements shall be, and is, a separate
enactment and is a direct exercise of the City's
governmental police powers enacted to protect the lives
and safety of its citizen and also to protect property
against fire. As such these provisions are free-
standing and are not amendments of the Uniform Fire or

Building Code, provided however, that no building or
other permit shall be issued until the provisions of
this section have been complied with.
Section 2. The City Council hereby declares that an
emergency exists necessitating that this ordinance take effect
immediately upon passage by unanimous vote of the members of the
City Council.
