ORDINANCE NO. 2612
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 5.50.020(A)(2) OF THE EDMONDS CITY CODE
TO INCREASE THE MAXIMUM PENALTY IMPOSED UPON PERSONS
VIOLATING ANY OF THE PROVISIONS OF SECTION 5.01.040 OF
THE EDMONDS CITY CODE ENTITLED CONTEMPT BY ADDING A
POTENTIAL SENTENCE OF UP TO ONE YEAR IN JAIL, DECLARING
AN EMERGENCY AND FIXING AN EFFECTIVE DATE.
WHEREAS, the Edmonds City Council finds that it is in the
public interest to provide for the possibilty of the imposition of a
jail sentence of up to one (1) year in addition to the current
maximum fine of Five Thousand Dollars ($5,000) for persons violating
the provisions relating to contempt, and
WHEREAS, the Edmonds City Council finds that this ordinance is
an emergency necessary to the protection of the public health,
safety, and welfare, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section 1. Section 5.50.020(A)(2) of the Edmonds City Code is
hereby amended to read as follows:
2. Any person violating any of the provisions of Title 5
shall be punished by a fine not to exceed Five Thousand
Dollars ($5,000), except that the following chapters and
sections of Title 5 shall be punished by a fine not to
exceed Five Thousand Dollars ($5,000), or by imprisonment
and jail not exceeding one (1) year, or by both such fine
and imprisonment:
Chapter 5.34 - Persons, Crimes Relating to
Chapter 5.38 - Public Morals, Crimes Relating to
Chapter 5.12 - Children and Minors, Crimes Relating to
Chapter 5.14 - Controlled Substances, Paraphernalia and
Toxic Fumes

Section 2. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a
court of competent jurisdiction, such invalidity or unconstitu-
tionality shall not affect the validity or constitutionality of any
other section, sentence, clause or phrase of this ordinance.
Section 3. The City Council hereby declares that an
emergency exists necessitating that this ordinance take effect
immediately upon passage by unanimous vote of the members of the
City Council.
