ORDINANCE NO. 2618
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING A PORTION OF THE UNBUILT
RIGHT-OF-WAY OF 78TH AVENUE WEST, BETWEEN
236TH AND 238TH SOUTHWEST, AND FIXING A TIME
WHEN SAME SHALL BECOME EFFECTIVE
WHEREAS, pursuant to ordinance and statute, the City of
Edmonds, Washington, held a hearing to consider the proposed
vacation (ST-1-87) of a portion of the right of way of 78th
Avenue West lying between 236th and 238th Streets Southwest,
further shown and described in paragraph 1 hereof, and
WHEREAS, pursuant to the findings of the City's
responsible official, the City Council finds that there will be
no signficant adverse environmental impact, and
WHEREAS, this Council has received the findings and
recommendations of its hearing examiner, and based thereon and
upon the testimony derived at its hearing finds that the property
should be vacated and that said vacation does not require
reservation of any easement, nor does it require the payment of
compensation therefore, in that said right of way was originally
dedicated by the current applicant, and no compensation should
therefore be paid in accordance with established City policy, NOW
THEREFORE,
THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. That the following described easement
previously dedicated for street purposes is hereby vacated. Said
easement is located within the City of Edmonds, Snohomish County,
Washington, being described as a portion of the dedicated but
unbuilt right of way of 78th Avenue West, lying between 236th and
238th Streets Southwest, and being further legally described as:
The East 20 feet of the West 30 feet of the South 416
feet of the West 208.7 feet of the Northeast corner of
the Northeast quarter of the Southeast quarter of
Section 31, Township 27 North, range 4 East, W.M.
situated in the County of Snohomish, State of
Washington.
Section 2. The City Clerk is hereby directed to file a
certified copy of this ordinance with the Snohomish County
Auditor.
Section 3. This ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the summary which is hereby approved.
