AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.14.040 OF THE EDMONDS CITY CODE
REGULATING THE HEIGHT AND LOCATION OF FENCES AND/OR
HEDGES PURSUANT TO PLANNING COMMISSION RESOLUTION
NO. 463.
WHEREAS, the City Council of the City of Edmonds, Washington,
pursuant to Planning Commission Resolution No. 463, called a
public hearing, and having during said hearing determined it to
be in the best interests and the public health, safety and
welfare to amend the Edmonds Zoning Ordinance as set forth
below, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 12.14.040 of the Edmonds City Code is
hereby amended to read as follows:
"12.14.040 General Requirements for Fences -- Hedges.
Fences or hedges providing a maximum of six (6)
feet of sight obstruction from adjacent properties
may be built on the side and rear property lines,
and across the front of the property, but not closer
to the street right-of-way than twenty (20) feet.
Corner lots must observe the twenty foot fence set-
back line to the rights -of -way of both streets.
Within the setback area, it is permissible to con-
struct a solid fence or hedge, a maximum of three (3)
feet in height measured from the level of the ground
on which the fence or hedge stands or an open rail
fence a maximum of six (6) feet in height where the
rails and posts constitute not more than one-third
of the vertical fence area. Where fence heights
greater than those contained in this section are
otherwise permitted, the provision permitting the
greatest height shall be deemed controlling.
Regardless of any provision contained herein, no
fence or hedge shall be constructed or maintained
such that it constitutes a hazard to adjoining prop-
erties, the public right-of-way or the use of said
public right-of-way. Deviations from the three-
foot height limitation within the setback area to
a maximum of six feet in height in said setback area
may be approved by the building official subject to
the following conditions:

(1) Two copies of plot plans and elevations
drawn to scale showing the size, construction and
nature of the materials for any such proposed fence
or hedge, the location of all existing structures,
street improvements, driveways and landscaping
shall be submitted to the Building Department.
(2) The City Planner and the City Engineer
shall review the submitted plan and shall approve
or disapprove the requested deviation based upon
factors of traffic visibility and other public and
private safety considerations, lot configuration,
location and topography and the nature, location
and extent of adjoining public and private struc-
tures and other improvements. In the event the
City Planner and the City Engineer disapprove such
requested deviation, no permit shall be issued by
the Building Department for construction of the
same.
Greenbelt or sight -obscuring constructions, where
required by provisions in this zoning code, shall
be of dense coniferous plantings, or climbing varieties
or nondeciduous vines on permanently installed
aluminum mesh fencing, or architectural fencing of
such design and material that retains its attractiveness
with nominal maintenance.
