AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING CHAPTER 11.02 OF THE EDMONDS CITY CODE BY
ADDING A NEW SECTION, SECTION 11.01.036 TO SAID
CODE REQUIRING THE EXECUTION OF A COVENANT TO THE
CITY OF EDMONDS TO BE RECORDED AT THE COST AND
EXPENSE OF AN APPLICANT FOR BUILDING PERMIT SETTING
FORTH THE NUMBER OF UNITS OF MULTI -FAMILY HOUSING
PERMITTED TO BE BUILT ON THE THEREIN DESCRIBED REAL
PROPERTY AS A CONDITION PRECEDENT TO OBTAINING A
BUILDING PERMIT FOR SUCH MULTI -FAMILY UNITS.
WHEREAS, it has come to the attention of the City,
Council of the City of Edmonds, Washington, that there have
been a number of violations of the Ordinances of said City
by virtue of construction of additional multi -family dwelling
units in such multiple residental buildings beyond what is
permissable by the Zoning Code of the City of Edmonds,
and
WHEREAS, it has been brought to the attention of the
City Council that subsequent purchasers of said properties
have taken ownership without notice or knowledge that there
were illegal multi -family dwelling units thus installed and
have thus had to bear the consequence of resolving the
problem thereby created either by the acquisition of additional
land to bring them into compliance with the Zoning Code of
the City of Edmonds, or by discontinuing the use of said
extra multi -family dwelling units and
WHEREAS, it is in the interest of the public health,
safety and general welfare and the City Council so finds
that it is necessary, to impose restrictions on the issuance
of building permits for such multi -family dewelling units in
order to establish as a matter of record for all subsequent
purchasers of real property with multi -family dwelling units
located thereon the number of said units permitted to be
constructed, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. A new section Section .11.02..036 is hereby
added to the Edmonds City Code to read as follows:
Section.11.02..0'36. Requirement of Covenant as to
Number of Permitted Dwelling' Units for Multiple Family
Residential. Buildings. Prior to the issuance of a
building permit for the construction of any multiple
family residential structure or building, the applicant
for such building permit shall obtain and file with the
City Building Inspector a covenant running from the
owners of the real property upon which said building
structure is to be built, as grantors, to the City of
Edmonds, as grantee, which covenant shall set forth
the maximum number of dwelling units permitted under
the then existing ordinances of the City to be constructed
on the real property therein described for which the
building permit application has been made. Said covenant
shall be recorded at the cost of the applicant with the
Snohomish County Auditor. Said covenant shall be a
restriction that shall run with the land and shall
constitute notice to all subsequent purchases of the
number of multiple family dwelling units permitted to
be.built upon said land. The Building Official may
require the applicant to furnish a report from a title
insurance company doing business in Snohomish County
to verify the ownership of the grantor.
