AN ORDINANCE VACATING A PORTION OF ELM STREET
BETWEEN FIFTH AND SIXTH AVENUES, IN THE CITY OF
EDMONDS, WASHINGTON, RETAINING AN EASEMENT AND
RESERVING TO THE CITY OF EDMONDS THE RIGHT TO
EXERCISE & GRANT EASEMENTS THEREON FOR PUBLIC
UTILITIES AND SERVICES.
WHEREAS, a petition to vacate a street was filed with
the City Council of the City of Edmonds, signed by the owners
of more than two-thirds of the property abutting upon property
dedicated for street purposes, located in the City of Edmonds,
being a portion of Elm Street between Fifth and Sixth Avenues,
more particularly described below, and
WHEREAS, the City Council of the City of Edmonds did by
Resolution No. 336 of said City duly adopted on the 15th day
of July, 1975, set the 19th day of August, 1975, at the hour
of 7:30 p.m. of said day, for the hearing and determination on
said vacation, and
WHEREAS, it appears to the City Council that said portion
of Elm Street between Fifth and Sixth Avenues should be vacated,
and the said City Council does hereby determine to vacate the
same, as hereinafter set forth,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS,
DO ORDAIN AS FOLLOWS:
Section 1. That the following described street in the
City of Edmonds, Snohomish County, Washington, being a portion
of Elm Street between Fifth and Sixth Avenues, legally described
as follows:
The North 40 feet of the North one-half of the North
one-half of the Northwest one -quarter of the Northwest
one -quarter of the Southwest one -quarter of Section 25,
Township 27 North, Range 3 East, W.M., lying westerly
of the southerly projection of the east line of Lot 1,
Plat of Highland Park, as recorded in records of
Snohomish County, Washington, LESS State Route #104
right-of-way.
be and the same is HEREBY VACATED, PROVIDED, HOWEVER, such vaca-
tion shall not become effective until the owners of the property
abutting said street or part thereof shall compensate the City
in an amount not exceeding one-half the appraised value of the
area so vacated, to wit the sum of $ 500.00 , and
provided, further that the City of Edmonds hereby retains an
easement and reserves the right to exercise and grant easements
in respect to said vacated land for the construction, repair,
maintenance and access to any and all public utilities and
services presently in existence in said area or as may be
installed in the future.
Section 2 The City Clerk is hereby instructed to file a
certified copy of this Ordinance with the Snohomish County
Auditor upon compliance with the conditions contained in
Section 1 hereinabove.
