ORDINANCE NO. 2363
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE TITLE OF CHAPTER 2.10
OF THE EDMONDS CITY CODE, DELETING CERTAIN
SECTIONS OF THAT CHAPTER, RENUMBERING OTHER
SECTIONS OF THAT CHAPTER, AND AMENDING
SECTIONS OF CHAPTER 2.10 TO REFLECT MORE
PRECISELY THE ORGANIZATIONAL STRUCTURE,
CONFIRMATION BY THE CITY COUNCIL OF, AND
DUTIES OF CITY OFFICERS, PROVIDING FOR A
SEVERABILITY CLAUSE AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the Mayor and the City Council have discussed
the present level of Council confirmation and appointments of
prospective employees, commission and board members; and
WHEREAS, the organizational structure of the City has
changed; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Chapter 2.10 of the Edmonds City code is
hereby retitled as follows:
Chapter 2.10
CONFIRMATION AND DUTIES OF CITY OFFICERS
Section 2. The following sections of the Edmonds City
Code are hereby repealed:
2.10.011 2.10.041
2.10.012 2.10.042
2.10.040
Section 3. Edmonds City Code Section 2.10.060 entitled
POLICE CHIEF is hereby renumbered as 2.10.030. Edmonds City Code

Section 2.10.065 entitled FIRE CHIEF is hereby renumbered as
2.10.031.
Section 4. Section 2.10.010 of the Edmonds City Code
is hereby amended to read as follows:
2.10.010 CONFIRMATION PROCESS
A. Whenever a vacancy occurs in one of the
positions listed in this section, the
city council will review the
specifications of that position and
revise it as needed before the vacancy is
filled.
B. The Mayor or his/her designee will review
all applications and determine the
persons with the highest qualifications.
Any city council member, upon request to
the Mayor, may review the applications
received for the vacant position.
C. The Mayor shall appoint, subject to
council confirmation, the positions of
City Attorney, Judge, Hearing Examiner,
Police Chief, Fire Chief, Community
Services Director and Administrative
Services Director. The City Council will
interview the top three candidates for
each position prior to the Mayor's final
selection
D. The Mayor shall appoint, subject to
council confirmation, the positions of
City Engineer, Planning Manager, Parks
and Recreation Manager, Public Works
Superintendent, and the Personnel
Manager. The city council will interview
only the person that the Mayor selects
for appointment.
Section 5. Section 2.10.025 of the Edmonds City Code
is hereby amended to read as follows:

2.10.025 DIRECTOR OF ADMINISTRATIVE SERVICES
- DUTIES
In addition to other duties assigned by the
Mayor, the Director of Administrative Services
shall have the following duties:
A. Under the general direction of the Mayor
the Director shall plan, organize and
direct the financial, data processing,
and record service functions of the city.
In addition, the Director shall:
1. Administer the insurance and risk
management program;
2. Organize and direct the activities
of the administrative services
department;
3. Through the Division of the
Accounting Manager, oversee and
direct the maintenance of financial
operations;
4. Through the Division of Data
Processing and Programming, oversee
and direct the maintenance of
information processing operations;
5. Through the Division of the City
Clerk, oversee and direct the
maintenance of record service
operations. In the absence of the
City Clerk, any duty prescribed by
law to be performed by the Clerk
shall be performed by the
Administrative Services Director;
6. Approve all selections, transfers,
promotions, performance evaluations
and termination of employees
assigned to the department. These
functions shall be conducted for and
on behalf of the respective division
managers;
7. Advise the Mayor, managerial staff
and City Council regarding budget
preparation process, the
consequences of fiscal alternatives
and the presentation and

recommendation of options in those
regards;
8. Assure through his/her function as
insurance and risk manager that
risks and losses are minimized,
insurance coverage is adequate and
properties of the city are properly
insured;
9. Approve purchases of materials,
services and equipment where the
cost exceeds the amount referenced
in the City's purchasing manual and
is less than that established for
statutory bidding procedures by
state law;
10. Assure the maintenance and operation
of all real properties of the city;
and
11. Serve on the Fireman's Pension
Board, the Municipal Employee
Benefit Trust Committee, and other
organizations as determined by the
Mayor. The Director shall maintain
contact with other jurisdictions and
the private sector in regard to
fiscal matters.
B. Any reference made in these ordinances to
duties assigned or the responsibility of
the Finance Director or Treasurer shall
be construed to refer to the Director of
Administrative Services or his/her
designee.
Section 6. Section 2.10.027 is retitled to read as
DIRECTOR OF COMMUNITY SERVICES.
Section 7. Section 2.10.028 is hereby amended to read
as follows:
2.10.028 DIRECTOR OF COMMUNITY SERVICES -
DUTIES
A. In addition to any other duties assigned
by the Mayor, the Director of Community
Services shall have the following duties:

1. Execute the decisions of the Mayor
and city council relating to
departmental responsibilities and
provide overall management for
engineering division, public works
division, planning division, and
parks and recreation division. The
director shall report to the mayor
as a member of a management team
that reviews and develops policies
and procedures for the improvement
of city operations and functions;
2. Direct overall division operations,
including engineering, buildings and
grounds, streets, water/sewer, the
treatment plant, equipment rental,
planning, and parks and recreation
activities;
3. Be ultimately responsible for making
budget proposals and requests and
controlling department expenditures
and receipts for the divisions of
the community services department;
4. To manage through division managers
the operations of the divisions
including the determination,
assignment and supervision of
employee workloads, provision for
appropriate training, conduct of
employee performance evaluations of
division managers, and effective
recommendation of formal personnel
actions to the mayor including
hiring, firing, disciplinary
measures, salary adjustments, and
promotions;
5. Advise the mayor, city council,
division managers and others on
engineering, public works, planning,
building and parks and recreation
related matters;
6. Develop systems, procedures and
practices applicable to the affected
functions;
7. Be ultimately responsible for
professional and comprehensive

planning and to propose changes and
updates of the comprehensive policy
plan map and community development
code;
8. Prepare and recommend capital
improvement programs;
9. Monitor engineering aspects of city
contracts and oversee the
preparation of contracts for
consulting services or construction;
and
10. Supervise and support the city's
safety program through the divisions
which the director supervises.
B. Any reference made in these ordinances to
duties assigned to or the responsibility
of the Director of Public Works shall be
construed to refer to the Director of
Community Services or his/her designee.
Section 8. Section 2.10.034 is hereby amended to read
as follows:
2.10.034 CITY ENGINEER
There is created the office of City Engineer,
which shall report to the Community Services
Director. This position shall be filled
through the recommendation of the Community
Services Director and the appointment by the
Mayor, subject to confirmation by the city
council and who shall serve at the pleasure of
the Mayor. The City Engineer shall be in
charge of the Engineering Division and shall
perform such other duties as may be assigned.
Section 9. Section 2.10.040 is hereby amended to read
as follows:
2.10.040 PLANNING MANAGER
A. There is created the office of the
Planning Manager, which shall report to
the Community Services Director. This
position shall be filled through the
recommendation of the Community Services

Director and appointment by the Mayor,
subject to confirmation by the city
council.
B. The Planning Manager shall direct the
Planning Division in addition to such
other duties as may be assigned.
C. The Planning Manager shall have the
customary duties of the City Planner,
including but not limited to advising and
making recommendations to the city
council, Planning Advisory Board, and
such other boards and bodies within the
City of Edmonds requesting and needing
assistance; consulting with and advising
other City officials regarding planning
matters and coordination of the inter-
related parts thereof with primary
emphasis on various comprehensive plans
of the City, zoning, planning and
subdivision, comprehensive street plans,
utilities and park development; and such
other matters as from time to time may be
directed by the city council and/or the
Mayor.
Section 10. Section 2.10.043 is hereby amended to read
as follows:
2.10.043 PUBLIC WORKS SUPERINTENDENT
A. There is hereby created the office of the
Public Works Superintendent which shall report
to the Community Services Director. This
position shall be filled through the
recommendation of the Community Services
Director and appointment by the Mayor, subject
to confirmation by the city council.
B. The Public Works Superintendent shall direct
the Public Works Division, in addition to
other duties as may be assigned.
Section 11. Section 2.10.050 is hereby amended to read
as follows:

2.10.050 PARKS AND RECREATION MANAGER
A. There is hereby created the office of the
Parks and Recreation Manager which shall
report to the Community Services
Director. This position shall be filled
through the recommendation of the
Community Services Director and
appointment by the Mayor, subject to
confirmation by the city council.
B. The Parks and Recreation Manager shall
direct the Parks and Recreation Division,
in addition to such other duties as may
be assigned.
Section 12. Section 2.10.055 is hereby amended to read
as follows:
2.10.055 PERSONNEL MANAGER
A. There is hereby created the office of the
Personnel Manager which shall report to
the Mayor. This position shall be filled
through the recommendation and
appointment by the Mayor, subject to
confirmation by the city council.
B. The Personnel Manager shall plan,
supervise and coordinate all personnel
programs and personnel matters of the
City, in addition to such other duties as
may be assigned by the Mayor.
Section 13. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or unconstitutional
by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 14. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after

passage and publication of the ordinance or a summary thereof
consisting of the title.
