AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12..13..030 OF THE EDMONDS CITY .CODE TO
PERMIT THE .CONST.RUCT.ION OF TENNIS :COURT FENCES. OUTSIDE
THE "ALLOWABLE BUILDING AREA" SUBJECT TO THE GRANT OF A
CONDITIONAL USE PERMIT IN MODIFICATION OF PLANNING
COMMISSION RESOLUTION NO. 488.

WHEREAS, :the City Council of the City of Edmonds, Washington,
pursuant to Planning Commission Resolution No. 488. called a public
hearing and during said .hearing determined it to be in the best
interests. of the public health, .safety and welfare to amend the
Edmonds.Zoning Code as.set.forth below in modification of Planning
Commission Resolution No. 488, and
WHEREAS, the City Council having specifically found that there
is a need to permit.the. erection of fences .such as for tennis courts
in areas where such a height would otherwise be prohibited 'due
to the fact they are outside of the Allowable Building. Area of a
lot, and that such uses should be permitted in conjunction with the
uses permitted in Section 12.13.030 of .the Edmonds City Code; however,
the Council having also found that in order to insure the protection
of the public health, safety and general .welfare and property values
that whenever a fence or.structure is to be erected outside the
Allowable Building Area on a given lot that such should be subject
to review under specific criteria and subject to the issuance of
a. conditional use permit, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section. 12..13..030 of the: Edmonds City Code is hereby amended
by adding a new.sub.s.ection (g) to .read as follows:
"12..13..030.. Primary Uses in FRS Zones.
(g) Tennis court.fences outside.the "Allowable
Building Area" shall be .permitted subject to the grant
of a conditional use permit. The board's review shall
include but not be limited to the items set forth
hereinafter and such a permit shall only be issued if the
board in reviewing the items set forth hereinafter finds
the following:
1. That territorial views would not be impaired as
a result of construction of the proposed tennis
court fence in the yard setbacks at the height
specified by the applicant;
2. That the proposed fence does not create a hazard
to the public health, safety or welfare;
3. That the proposed fence does not impair the general
character of the neighborhood in which it is located.
