Ordinance 1824ORDINANCE NO. 1824 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, CREATING A CITIZEN'S SHORELINES MANAGEMENT ADVISORY COMMITTEE, ESTABLISHING THE NUMBERS OF SAID COMMITTEE AND THE TERMS SAID MEMBERS SHALL SERVE; ESTABLISHING OFFICERS, QUORUM AND MEETING DATES AND SETTING FORTH THE POWERS AND DUTIES OF SAID COMMITTEE. WHEREAS, the City of Edmonds, Washington, pursuant to the Shorelines Management Act of 19.71, Chapter 286, 1971, First Extra- ordinary Session, Laws of the State of Washington, has prepared a Shorelines Management Draft, Master Program, dated November 1, 1973, as amended, and a Shoreline Inventory, and WHEREAS, pursuant to said Shorelines Management Act of 1971, the City of Edmonds requested and obtained substantial involvement of the citizens of Edmonds by virtue of a Shorelines Management Citizens' Advisory Committee for the purpose of helping said city formulate said master program, and WHEREAS, it is deemed by the City Council of the City of Edmonds, Washington, that said Shorelines Management Draft, Master Program and Shoreline Inventory should be reviewed from time to time and an advisory committee shall be established for this purpose, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. There is hereby created a new chapter, Chapter 1.42 to Title l of the Edmonds City Code, entitled Shorelines Management Citizens' Advisory Committee. Section 2. Section 1.42.010 Creation -Eligibility. There is hereby created a Shorelines Management Citizens' Advisory Committee, consisting of nine members, who shall be appointed by the Mayor, with the confirmation of the City Council, seven of whom shall reside in the City of Edmonds. Section 3. Section 1.42.020 Terris of Membershi-P. The initial membership of the Shorelines Management Citizens Advisory Committee shall be made up of members serving on the ad hoc committee which drafted the Edmonds Shoreline Master Program. In the event there are not nine members of said ad hoc committee able or willing to so serve or in the case of any appointment for any position subsequent to the initial term then appointments may be made of any other eligible persons. The term of membership for the members of said committee shall be three .(3) years, provided, however, that in order that the fewest terms will expire in any one year, the terms of the first appointed members shall expire on the annual anniversary date of the effective date of this section as follows: Position No. 1. . . . . .1977 Position No. 2. . . . . .1977 Position No. 3. . . . . .1977 Position No. 4. . . . . .1978 Position No. 5. . . . . .1978 Position No. 6. . . . . .1978 Position No. 7. . . . . .1979 Position No. 8. . . . . .1979 Position No. 9. . . . . .1979 The initial positions for each member shall be determined by lot after their appointment and confirmation. Vacancies occurring otherwise than through the expiration of term may be filled for the unexpired term. Members may be removed, after public hearing, by the Mayor, with the approval of the City Council, for inefficiency, neglect of duty, or malfeasance in office. Section 4. Section 1.42.030 Officers* of Committee Meetings - Quorum. Members of the committee shall meet and organize by electing from the members of the committee, a chairman and vice- chairman, and such other officers as may be determined by the committee. It shall be the duty of the chairman to preside at all meetings, and the person chairing said meetings shall vote only in case of a tie. The vice-chairman shall perform the chairman's duty in the absence of the chairman. A majority of the committee shall constitute a quorum for the transaction of business. A majority of a quorum may transact any particular business of the committee. A public meeting of the committee shall be held on the first Thursday of May and November of each year at 7:30 p.m. at the Civic Center, or at such other times as directed by the Mayor and City Council, or at the request of the Chairman of the Committee or a quorum of its members. The committee, in the event that it is unable to complete its business at its regular public meeting shall continue said meeting to a date or dates certain until such business is completed. Section 5. Section 1.42.040 Powers and Duties. The com- mittee is empowered to review the City of Edmonds Shorelines Management Master Program and Amendments thereto, and the Shoreline Inventory and to advise and make recommendations to the Mayor, City Council, Planning Commission and/or the Planning Department on matters relating to said review, including the recommendation of modifications or alterations to said Shorelines Management Master Program and Shoreline Inventory and recommenda- tions for implementation of the Edmonds Policy Plan and other city policies or ordinances relating to the Shoreline.
