AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
RELATING TO COUNCIL ELECTIONS AND FILLING OF VACANT
COUNCIL POSITIONS; REPEALING CHAPTER 1.12 OF THE
EDMONDS CITY CODE AND ADDING A NEW SECTION 1.01.035
TO THE EDMONDS CITY CODE.
WHEREAS, the City of Edmonds has exercised its option
to become a non -charter optional municipal code city under
a mayor/council form of government as provided in RCW Chapter
35A.12, and
WHEREAS, there are certain sections in Chapter 1.12 of
the Edmonds City Code which were in existence prior -to the
City becoming an optional municipal code which are no longer
of any force and effect and should be repealed, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section. 1. Chapter 1.12 and sections 1.12.010 through
1.12.050 are hereby repealed.
Section 2. There is hereby added to Chapter 1..01 a new
section 1..01..035 to read as follows:
"1.01.035. Filling vacant council positions. In the
event a vacancy or vacancies shall occur on the city
council, such position or positions shall be filled until
a successor to such position or positions can be elected
for the remainder of the unexpired term at the next
municipal election pursuant to the provisions of RCW
35A.12, in compliance with the following procedure:
1. The council shall, at the next regular meeting
following the occurrence of a vacancy set a date
within not.less than one week nor more than three
weeks at which time the city council shall meet to
nominate and appoint qualified persons to fill such
vacancy or vacancies. The date thus set shall be
a regular public meeting of the city council;
2. The city clerk shall be instructed to place the
matter on the agenda of the regular public meeting
thus selected under the title "Appointment to
Fill Council Vacancy";
3. The. city clerk shall cause notice of the date at
which time the city council shall nominate a person
or persons to fill the vacancy to be sent to each
local newspaper of general circulation and to each
local radio or television station which has on
file a written request to be notified of special
meetings in accordance with provisions of the open
public meetings act, RCW 42.30.080. In addition,
the city clerk shall cause notice to be posted of
such meeting at the Civic Center. Such notice shall
be mailed and posted the day following the setting
of the meeting date by the council;
4. The notice shall invite all qualified persons who
would desire to be appointed to the vacant position
to submit or have submitted on their behalf a written
resume summarizing their qualifications. Such resumes
shall be signed by the applicant or such other person
submitting the resume and shall be verified or
acknowledged in the presence of and by a notary
public. All resumes shall be filed with the city
clerk not later than by five p.m. on the Thursday
preceding the meeting at which nominations shall
be made and shall be available for inspection by the
public;
5. Only those persons who have submitted resumes or had
resumes submitted on their behalf, in compliance with
the preceding paragraph, shall be eligible for nomina-
tion to fill the vacancy.
