Ordinance 1847ORDINANCE NO. 1847 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTIONS 12.16.060 AND 12.16.140 OF THE EDMONDS CITY CODE PROVIDING FOR APPEALS FROM ORDERS, RECOMMENDATIONS, PERMITS, DECISIONS OR DETERMINATION BY ANY OFFICIAL OF THE CITY IN THE ADMINISTRATION OR ENFORCEMENT OF THE PRO- VISIONS OF THE EDMONDS ZONING AND PLATTING CODE (TITLE 12 OF THE EDMONDS CITY CODE) OR ANY ORDINANCES ADOPTED PURSUANT TO IT, PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 510. ......... . ..... WHEREAS, the City Council of the City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 510, called a public hearing, and having during said hearing determined it to be in the best interests of the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below, pursuant to Planning Commission Resolution No. 510, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 12.16.060 of the Edmonds City Code is hereby amended to read as follows: "12.16.060. Powers of the Board. The Board shall hear and decide appeals from any determination or inter- pretation made by any city official in the administra- tion or enforcement of the provisions of the Edmonds Zoning and Platting Code (Title 12 of the Edmonds City Code) or any ordinances adopted pursuant to it, except as otherwise specifically provided in the Edmonds City Code. The board shall also hear applications for con- ditional use and for variances except as otherwise provided, and such other matters as specifically authorized by the Edmonds City Code. Section 2. Section 12.16.140 of the Edmonds City Code is hereby amended to read as follows: "12.16.140. Stay. When any appeal is made to the Board from the decision of any city official with respect to the administration or enforcement of the provisions of the Edmonds Zoning and Platting Code (Title 12 of the Edmonds City Code) or any ordinances adopted pursuant to it, any further actions shall be stayed until the final determination by the Board of Adjustment. When an appeal is taken to the Superior Court from any decision of the Board, all proceedings therein shall be stayed until final determination by the Superior Court.
