AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.16.050 OF THE EDMONDS CITY CODE
TO INCREASE THE MEMBERSHIP OF THE BOARD OF ADJUSTMENT
FROM SEVEN TO NINE MEMBERS AND AMENDING SECTION
12.16.120 OF THE EDMONDS CITY CODE TO INCREASE THE
QUORUM REQUIREMENTS OF THE BOARD OF ADJUSTMENT FROM
FOUR TO FIVE.
WHEREAS, the City Council of the City of Edmonds, finds
that increasing the membership of the Board of Adjustment from
seven to nine members will enable the Board to operate more
effectively and provide a greater diversity of views in the
Board's deliberations, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 12.16.050 of the Edmonds City Code is
hereby amended to read as follows:
"12.16.050. Board of Adjustment. A Board of Adjustment
is established. The word "Board" when used herein shall
mean the Board of Adjustment. The Board shall consist
of nine members and shall be appointed by the Mayor with
approval of the Council. In case any vacancy should
occur in the membership of the Board for any cause, the
Mayor shall fill such vacancy by making an appointment
with the approval of the Council. The new appointee shall
fulfill the unexpired term. The members of the Board may
be removed by the Mayor, subject to the approval of the
Council, for neglect of duty or acts involving moral
turpitude. Before the removal of any member of the Board
of Adjustment, the allegations upon which the removal is
based, shall be set forth in writing and the members
being removed shall be given reasonable notice thereof
and he shall be given an opportunity to be heard before
the Council.
The terms of office shall be four years. Provided,
however, that at the time of amendment to this section
there are presently Board members serving terms which

will expire in a shorter period of time. Positions No.
8 and 9 newly created in this section shall, for the
initial term of such position, be for less than four
years. Each reappointment to a position shall be for
a four year term. In order to insure that the fewest
terms will expire in any one year, the terms of the
appointed positions by position number shall expire
on December 31st of the year set opposite said position
number as follows:
Position No. 1--Expires 1979
Position No. 2--Expires 1980
Position No. 3--Expires 1980
Position No. 4--Expires 1977
Position No. 5--Expires 1978
Position No. 6--Expires 1978
Position No. 7--Expires 1979
Position No. 8--Expires 1977
Position No. 9--Expires 1978"
Section 2. Section 12.16.120 of the Edmonds City Code
is hereby amended to read as follows:
"12.16.120. Meetings. Meetings of the Board shall be
held at least once a month, provided there is business
to transact and at such other times as the chairman of
the Board may determine. The meetings shall be held in
the Edmonds Civic Center and all regular Board meetings
shall be open to the public. The Board shall adopt its
own rules or procedure and keep minutes of its proceedings,
findings and action in each case, and the vote of each
member present on each question considered in the pro-
ceedings, unless a member disqualifies himself. The
presence of five members shall be necessary to consti-
tute a quorum and three affirmative votes shall be
necessary for granting a variance or a conditional use
permit."
