AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 11.02.025(f) OF THE EDMONDS CITY
CODE TO REQUIRE STREET, WATER, SEWER AND DRAINAGE
FACILITIES WHEN A BUILDING PERMIT IS ISSUED FOR
REMODELLING THAT WILL AFFECT ABUTTING PUBLIC
IMPROVEMENTS.
WHEREAS, Section 11.25.025(f) of the Edmonds City Code
presently requires that all new construction include plans for
the construction of street and utility work which is necessitated
by said new construction, and
WHEREAS, the City Council of the City of Edmonds finds
that when a building is remodeled, altered or improved, the
public health, safety and general welfare require that adequate
provisions be made for curbs, gutters, sidewalks, paved streets,
waterlines, sewerlines and storm drainage necessiated by said
change, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 11.02.025(f) of the Edmonds City Code is hereby
amended to read as follows:
"11.02.025(f). Utilities and Street Improvements. No
building permit shall be issued for the construction, en-
largement, alteration, improvement or conversion of any
building or structure of any kind or description unless
the plans and specifications include the construction for
curbs, gutters, sidewalks, paved streets, waterlines,
sewerlines, and storm drainage necessiated by the new
construction, conversion, alteration, enlargement or
improvement. Said street and utility improvements are
to be built to applicable city standards. Provided,
however, if found by the City Engineer to be impractical
to construct at the time of application for said building
permit, construction may be waived by the City Engineer
and in lieu thereof a performance bond filed with said
Engineer to cover the estimated cost of construction
to city standards for said improvements. Provided,
further, in areas zoned single-family residential at
the time of the application for building permit in which
the applicant has received final approval for a plat
or subdivision and has complied with requirements therein,
compliance with this subsection shall be deemed by
compliance with the subdivision or plat requirements."
