AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.10.050 (2)(c)(3) OF THE EDMONDS
SUBDIVISION CODE TO REQUIRE SUBMISSION OF GRADING
PLANS IN CONJUNCTION WITH CERTAIN SUBDIVISIONS AND
SHORT SUBDIVISIONS; ADDING A NEW SECTION 11.02.031
AMENDING SECTION 7006(a) OF THE UNIFORM BUILDING
CODE AS ADOPTED BY SECTION 11.02.010 OF THE EDMONDS
CITY CODE TO EXEMPT CERTAIN GRADING FROM CONDITIONAL
USE PERMITS; AND SUPPLEMENTING THE TABLE OF CONDITIONAL
USES CONTAINED IN SECTION 12.16.070 OF THE EDMONDS CITY
CODE PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 536.
WHEREAS, pursuant to Planning Commission Resolution No.
536 the City Council of the City of Edmonds, Washington,
called a public hearing and during said hearing having
determined it to be in the best interests of the public
health, safety and general welfare to amend the Edmonds
Subdivision Code as set forth below pursuant to Planning
Commission Resolution No. 536, and
WHEREAS, at said public hearing the City Council having
determined that the recommended amendments to the Edmonds
City Code will facilitate compliance with state and local
environmental laws and concerns and will promote orderly
development and use of property within said City and having
further determined that it would be in the best interests of
the public health, safety and general welfare to enact the
following amendments to the subdivision and building codes,
and further finding that there will be no significant
adverse environmental impacts as a result of said amend-
ments, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO

ORDAIN AS FOLLOWS:
Section 1. Section 12.10.050 (2)(c)(3) of the Edmonds
City Code is hereby amended to read as follows:
"12.10.050 (2)(c)(3). Topography. Placement of
streets and lots in relation to topography shall be
considered in order to minimize filling, grading or
other alterations of existing conditions Whenever the
proposed subdivision or short subdivision requires any
filling or grading in excess of 500 cubic yards, the
subdivider shall be required to submit a grading plan
showing the land contours both before and after the
proposed filling or grading."
Section 2. There is hereby created a new Section
11.02.031 of the Edmonds City Code to read as follows:
"11.02.031. Grading Permits --Section 7006(a) UBC.
Section 7006(a) of the Uniform Building Code as adopted
by reference under Section 11.02.010 of this Chapter is
amended to read as follows:
17006(a). Permits Required. Except as exempted
in Section 7003 of this Code, no person shall do
any grading without first obtaining a grading
permit from the Building Official. A separate
permit shall be required for each site, and may
cover both excavations and fills. A conditional
use permit shall be required for grading in excess
of five hundred (500) cubic yards, provided,
however, when the total amount of said grading is
necessary only to accommodate a structure applied
for in a building permit, the conditional use
permit shall not be required.'"
Section 3. The Table of Conditional Uses contained in
Section 12.16.070 of the Edmonds City Code is hereby sup-
plemented as set forth on Exhibit "A" attached hereto and
incorporated in full by this reference.

The Cascade Woodwind
Quintet will perform at a
free concert at 8 p.m.
March 10 at the Wade
James Theatre, 950 Main
St. Edmonds.
The concert will feature
selections from various
Periods of music, including
Mozart, Beethoven, Haydn,
Hindemuth, Agay and
Ibert. Quintet spokesman
Joy Hamilton said the
performance will feature
both "heavy and light"
music. The quintet members are
Robert DeCou, French
horn; Connie Backus, flute;
Herb Hamilton Jr.,
