ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING
ORDINANCE NO. 1678 AND CHAPTER 1.14 OF THE EDMONDS CITY
CODE BY REQUIRING THAT THE DISCLOSURE OF CERTAIN INFOR-
MATION BY THE MAYOR AND MEMBERS OF THE CITY COUNCIL;
PROHIBITING PARTICIPATION BY PUBLIC OFFICIALS IN CER-
TAIN PROCEEDINGS; AND ESTABLISHING AND CLARIFYING OF
ADVISORY OPINION PROCEDURE.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 1.14.040(2) of the Edmonds City
Code is hereby amended to read as follows:
"1.14.040(2) On all matters on which said public
official has failed to disclose any financial or
private interest of his own or his family in any matter
coming before the Council; provided, however, upon the
disclosure of such interest, said public official may
then take part in any action, including voting, dis-
cussion or persuasion, unless otherwise expressly
prohibited by the provisions of this ordinance, ap-
plicable State law or judicial decisions of the State
Appellate or Supreme Court."
Section 2. Sections 1.14.040(4), (5) and (6) are
hereby amended to read as follows:
"1.14.040(4) Any matter coming before the City
Council which would affect property, other than the
public official or his family's own residence, in which
the public official or his family may have a financial
or pecuniary interest.
(5) No public official shall appear before
any agency, board or commission of the City on behalf
of his own application. Provided, however, this pro-
hibition shall not extend to appearances on a public
official's own behalf, representing himself before the
Edmonds Municipal Court or before any of the depart-
ments of the City.
(6) No public official shall appear before
any agency, board, or commission of the City on behalf
of a client or on behalf of any other private interest."

Section 3. Sections 1.14.040(7), (8), (9) and (10)
are hereby repealed.
Section 4.
New sections 1.14.040(7) and (8) are
hereby added to the Edmonds City Code to read as follows:
"1.14.040(7) Requesting or permitting the use of
City -owned vehicles, equipment, materials, or property
for personal use or profit, unless such use is avail-
able to the general public.
(8) Disclosing confidential information
without legal authorization or using such information
to advance the private or financial interest of him-
self, his family or others."
Section 5.
read as follows:
Section 1.14.050(3) is hereby amended to
"1.14.050(3) City Clerk shall retain a record of the
hearing on each such matter thus brought before the
City Council, including the disposition of the matter
and the decision of a majority of the Council hearing
the question. All interpretations of this chapter and
opinions of the City Council shall be advisory only."
