AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.13.030 OF THE EDMONDS CITY
CODE ALLOWING PUBLIC AND INSTITUTIONAL USES IN RS
ZONES SUBJECT TO THE GRANT OF A CONDITIONAL USE
PERMIT.
WHEREAS, pursuant to Planning Commission Resolution
No. 556, the City Council of the City of Edmonds, Washing-
ton, called a public hearing and during said hearing, having
determined it to be in the best interests of the public health,
safety and general welfare to amend the Edmonds Zoning Ordi-
nance as set forth pursuant to Planning Commission Resolution
No. 556, and having determined there will be no significant
adverse environmental impacts, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 12.13.030 of the Edmonds City Code is hereby
amended to read as follows:
"12.13.030 Primary uses in RS districts. In an RS zone
the following primary uses only are permitted, as regu-
lated by this section and subject to the general pro-
visions and the exceptions set forth in this title:
(1) Single-family dwelling, but specifically excluding
mobile homes and trailers.
(2) The public and institutional uses specified herein
subject to the requirements set forth below:
(A) Public and Institutional Uses.
( i) Schools and educational institutions,
public, private and/or parochial;
( ii) Parks and recreation facilities;

Public libraries, art galleries and mu-
seums,
( iv) Municipal buildings and structures;
( v) Churches;
( vi) Auditoriums;
(vii) Private clubs and community centers.
(B) Building and Site Requirements.
( i) Setbacks for all yards - 25 feet or the dis-
tance of the height of the structure, which-
ever is greater;
( ii) Height - the same as set forth in Sec-
tion 12.13.050 of the Edmonds City Code;
Lot coverage - no more than 40 percent
of the site;
( iv) Lot size - minimum 12,000 square feet;
( v) Lot width - minimum 80 feet.
(C) Conditional Use Permit. Each such public and
institutional use shall be subject to the grant
of a conditional use permit from the City
Council. Before the City Council may grant any
such conditional use permit, the Planning Com-
mission shall hold a public hearing and forward
its recommendations to the City Council. Noti-
fication of the Planning Commission's hearing
shall be given as set forth in Section 12.16.170
of the Edmonds City Code. Subsequent to the
hearing and recommendations of the Planning Com-
mission, the City Council, at a public hearing,
may affirm, modify or reject any decision of the
Planning Commission.
In deciding whether a conditional use permit
should issue, the Planning Commission and the
City Council, in addition to all other rele-
vant factors shall find that:
( i) The proposed use will be in harmony
with adjoining land uses;
( ii) Screening will be provided to insure the
privacy of adjoining property owners, and
(iii) Provisions are made to insure safe pedes-
trian and vehicular access to and from
the site.

(3) Tennis court fences outside the allowable building
area shall be permitted subject to the grant of a
conditional use permit by the Board of Adjust-
ment. The Board's review shall include but
not be limited to the items set forth herein-
after and such a permit shall only be issued if
the Board in reviewing the items set forth here-
inafter finds the following:
(A) That territorial views would not be impaired
as a result of construction of the proposed
tennis court fence in the yard setbacks at
the height specified by the applicant;
(B) That the proposed fence does not create a
hazard to the public health, safety or welfare;
(C) That the proposed fence does not impair the
general character of the neighborhood in which
it is located.
