JAM/trs 10/3/80 ORDINANCE NO. 2182 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADOPTING A NEW COMMUNITY DEVELOPMENT CODE FOR SAID CITY AS NEW TITLES OF THE EDMONDS CITY CODE INCLUDING: TITLE 15 SETTING FORTH REVISED LAND USE APPLICATION FEES, REVISIONS TO THE COMPREHENSIVE PLAN AND ITS COMPONENT ELEMENTS; TITLE 16 SETTING FORTH REVISED ZONING DISTRICTS AND CLASSIFICATION OF LAND USE AND DEVELOPMENT; TITLE 17 ADOPTING A REVISED OFFICIAL ZONING MAP AND PROVIDING FOR ZONING ADMINISTRATION, BONDING, FENCES AND HEDGES, LAND AND BUILDING USES, PARKING REQUIREMENTS, AND PERFORMANCE STANDARDS; TITLE 18 SETTING FORTH PUBLIC WORK REQUIREMENTS AND RELATED STANDARDS INCLUDING WIRES AND WIRING, SEWER- AGE AND DRAINAGE, GRADING AND RETAINING, STREETS, RIGHTS -OF -WAY, SIDEWALKS, USE PERMITS, TREES AND PARKING LOTS; TITLE 19 ADOPTING UNIFORM BUILDING CODES AND RELATED CODES FOR HOUSING, ELECTRICAL, MECHANICAL, PLUMBING, MOVING, SIGNS, SWIMMING POOLS, MARINAS, FIRE PREVENTION AND SAFETY; TITLE 20 PROVIDING FOR REVIEW CRITERIA AND PROCEDURE FOR MATTERS WITHIN THE COMMUNITY DEVELOPMENT CODE AND PROVIDING FOR SPECIAL PERMITS OF CONDITIONAL USE, VARIANCE, ARCHITECTURAL DESIGN, ENVIRONMENT, GROUP HOMES, HOME OCCUPATIONS, HOUSING FOR THE ELDERLY, JOINT PARKING, PLANNED RESIDENTIAL DEVELOPMENT, SETBACKS, SHORELINE, SIGNS, STREET MAP CHANGES AND VACATION, SUBDIVISIONS OF LAND, AMENDMENTS TO CODE TEXT AND OFFICIAL MAPS, PROVIDING FOR PUBLIC NOTICE AND PROVIDING FOR REVIEW BY CITY STAFF, PLAN- NING ADVISORY BOARD, HEARING EXAMINER, CITY COUNCIL AND COURTS; AND TITLE 21 ADOPTING NEW AND REVISED DEFINITIONS FOR SAID CODE; MAKING PROVISION FOR SUPERSEDING PRIOR CITY LAND USE REGULATIONS, OFFICIAL ZONING MAP AND GUIDELINES SET FORTH IN PRIOR CITY CODE TITLE 12 (ZONING AND PLATTING) AND TITLE 20 (SIGN CODE); AND PROVIDING PENALTIES. WHEREAS, the Planning Commission held numerous public hearings pursuant to public notice of the initiation of the same and made recom- mendation to the City Council for the adoption of a new community development code, and WHEREAS, the City Council called and held a series of public hearings on said proposed community development code and as a result of said further public consideration and staff recommendation directed certain modifications to said code, and WHEREAS, thereafter the Planning Commission held a public hearing to revise the Official Zoning Map to conform to the zoning text revisions and nomenclature of districts and otherwise up -date the exist- ing zoning map, and having recommended the adoption of said map to the City Council for adoption contemporaneously with the adoption of a new community development code, and WHEREAS, the City's responsible official has issued a declara- tion of significance, and thereafter a draft environmental impact state- ment was prepared and circulated as required by law and after the required comment period a final environmental impact statement was prepared for use by the city Planning Commission and City Council, and WHEREAS, the City Council finds the adoption of said code and related maps and materials will benefit the public safety, morals and general welfare, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Adoption. The following Titles are hereby adopted as new Titles to the Edmonds City Code: Title 15 (Comprehensive Plan); Title 16 (Zoning Districts); Title 17 (General Zoning Regulations); Title 18 (Public Works Requirements); Title 19 (Building Codes); Title 20 (Review Criteria and Procedures); and Title 21 (Definitions): Section 2. Superseded Codes. All ordinances and portions of ordinances, maps, charts, diagrams and other provisions of the Edmonds City Code inconsistent with the provisions of the Community Development Code set forth above as new Titles 15-21 of the Edmonds City Code are hereby superseded, including but not limited to the following: Title 10 (Fire); Title 11 (Buildings); Title 12 (Zoning and Platting); Title 20 (Signs); Chapter 6.30 (Underground Electric and Communications Facilities); Chapter 6.40 (Use of Public Places); Chapter 7.01 (Street and Sidewalk Standard Specifications); Chapter 7.12 (Datum Line); Chapter 7.18 (Trees); Chapter 7.20 (Sidewalk Construction); Chapter 7.24 (Street Obstruction); Chapter 7.28 (Street Names and Numbering); and Chapter 7.30 (Excavations). Section 3. Revival. In the event any provision of the Community Development Code, including the Official Zoning Map, or any other diagram, chart or code adopted by it, is found to be invalid or inapplicable to any property or person subject to the jurisdiction of the City of Edmonds, said invalid or inapplicable provision or portion shall be deemed repealed and the former provisions herein superseded shall be deemed revived and in full force and effect as if they had not been superseded. Section 4. Savings. Nothing contained in this ordinance or in the Community Development Code adopted herein, including maps, charts, diagrams and codes therein adopted, shall be construed as abating any action now pending under or by virtue of any provision of the Edmonds City Code herein superseded or as discontinuing, abating, modifying or altering any penalty accrued or to accrue or as affecting the liability of any person, or as waiving any right of the City under any ordinance or provision in force at the time of passage or the effective date of this ordinance. Section 5. Transition. All pending permits, applications and approvals not having received final city approval on the effective date of the new community development code (January 1, 1981) shall be governed by the procedural requirements of the new community development code, including, but not limited to provisions for payment of fees, applica- tion or other information, time limits for appeals, hearing procedures and officers, notices and appeal procedures. All pending permits, applications and approvals not having received final city approval on said effective date of the new community development code shall be required to comply with all substantive provisions of the new community development code prior to final approval, unless the applicant or project has vested rights to substantive provisions of prior city ordinances. Section 6. Vested Rights. A. Vested rights for subdivisions and short subdivisions shall be governed by the provisions of Section 20.75.165 of the new community development code. B. Planned Residential Developments which have received design review approval by the City Council on or before December 31, 1980, must receive final approval by the City Council within one year of design review approval and must thereafter complete the project within two years of the adoption of the authorizing ordinance. If the final approvals are not received or the project not completed as set forth herein, the project must comply with all provisions of the new community development code, as herein adopted or as may be subsequently amended. No extensions of time for receiving final approval or for completion of the project shall be granted by the City. C. Projects and developments governed by provisions of concomitant zoning agreements shall be required to comply with the terms of said zoning agreements. Changes in the zoning text, nomenclature of zone districts, and Official Zoning Map made by adoption of the new community development code, or any subsequent amendments, shall not be deemed to affect the property covered by said zoning agreements, unless authorized by the terms thereof. D. Nothing in this ordinance or the new community develop- ment code shall be deemed to grant any person, project or development any vested right, except as otherwise expressly provided. Section 7. Severability. If any provision of this ordinance is held invalid in whole or in part, the remaining portions of this ordinance shall not be affected. Section 8. Effective Date. This ordinance and the new com- munity development code, including all codes, maps, charts and diagrams adopted therein, shall be in full force and effect on and after January 1, 1981.
