ORDINANCE NO. 2269
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 20.105.020(B) TO
CLARIFY AN AMBIGUITY REGARDING THE LENGTH
OF THE APPEAL PERIOD FOR APPEALS FROM
STAFF AND HEARING EXAMINER DECISIONS; AND
ADDING A NEW SECTION 21.115.030 DEFINING
THE TERM "WORKING DAY".
WHEREAS, the Community Development Code currently
prescribes the time for filing an appeal with the Planning
Director as "within ten days" in Section 20.105.020(B), and
WHEREAS, the City Council finds that this section
should be amended to clarify potential ambiguities in such
language by referring to such appeal period in terms of
"working days", and
WHEREAS, the City Council finds that it is necessary
to define the term "working day" in order to remove any ques-
tion regarding the length of time in which to file an appeal
of a staff or Hearing Examiner decision, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 20.105.020(B) of the Community
Development Code is hereby amended as follows:
-� B. Filing the Appeal. The person appealing shall
file the appeal with the Community Development
Director within ten working days after the date
of the decision being appealed. If an appeal
is properly filed within the time limit, the
appealed decision shall be suspended until the
appeal has been acted on, and no further devel-
opment action which was the subject of the
decision may be taken. If no public hearing
has been held earlier, the person appealing
shall also provide a list of property owners as
specified in 20.95.010 and whom must be noti-
fied by the Community Development Department.
Section 2. A new Section 21.115.030 is hereby added
to Chapter 21.115 of the Community Development Code to define
the term "working day" as follows:
21.115.030 WORKING DAY
Working day means any day during which the City adminis-
trative offices are open for normal business.
Section 3. This ordinance shall be in full force
and effect five days after passage and publication by posting
as provided by law.
