ORDINANCE NO. 2271
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 17.50.070(A) OF
THE COMMUNITY DEVELOPMENT CODE TO PROVIDE
FOR CITY COUNCIL APPROVAL OF CERTAIN PRO-
POSALS TO SATISFY THE PARKING REQUIREMENTS
IN THE DOWNTOWN BUSINESS AREA BY PAYMENT OF
A FEE IN LIEU OF CONSTRUCTING OFF-STREET
PARKING; AND ADDING A NEW SUBSECTION "E" TO
SECTION 17.50.070 OF THE COMMUNITY DEVEL-
OPMENT CODE ESTABLISHING A PARKING FUND AND
PROVIDING FOR THE SPECIAL USE OF SUCH FUND.
WHEREAS, prior to this amendment, the Community
Development Code permited the Planning Director to decide
without a hearing if the parking requirements for a partic-
ular project located in the downtown business area may be
partially met by the payment of a fee in lieu of constructing
off-street parking spaces, and
WHEREAS, the City Council finds that the interests
of the City of Edmonds are better served if the City Council
takes responsibility for determining whether satisfaction of
downtown parking requirements by payment of an in lieu of fee
in certain cases is appropriate, and
WHEREAS, prior to the passage of this ordinance,
payment made in lieu of constructing required on -site, off-
street parking spaces pursuant to Section 17.50.070 of the
Community Development Code was deposited into an "off-street
parking fund" whose use was limited to the development of
off-street parking facilities, and
WHEREAS, the City Council finds that funds collected
pursuant to Section 17.50.070 of the Community Development
Code should be made available for other projects designed to
provide adequate parking in the Downtown Business Area in
addition to off-street parking facilities, and
WHEREAS, the proposed wider use of a parking fund
would facilitate more appropriate solutions to potential
downtown parking needs and is therefore in the City's best
interests, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 17.50.070A of the Community
Development Code is hereby amended to designate the projects
for which the Planning Director may determine the percentage
of parking spaces to be provided by payment of a fee in lieu
of constructing off-street parking spaces and to read as
follows:
A. In -Lieu Fee The parking requirements for a
business use in the Downtown Business Area may
be partially or entirely satisfied by payment
of a fee in lieu of constructing off-street
parking spaces.
1. The number of spaces allowed to be satis-
fied in this manner shall be determined as
follows:
a. For those business uses whose total
parking requirement is ten spaces or
less, the Planning Director, using the
procedures set forth in Section
20.95.040, may approve in lieu payment
for up to 50% of the required spaces.
b. For those business uses whose total
parking requirement is eleven spaces or

more, the Planning Director, using the
procedures set forth in Section
20.95.040, may approve in lieu payment
for one to five spaces.
C. For all business uses requesting in
lieu payment for more than 50% of
required spaces where ten or less
spaces are required and for all busi-
ness uses requesting in lieu payment
for more than five spaces where eleven
or more spaces are required, the City
Council may grant approval after a
public hearing using the procedures and
notice requirements set forth in
Section 20.90.010.
2. The criteria for determining the number of
spaces eligible for payment in lieu of
constructing off-street parking shall
include the following:
a. The amount of available on -street
parking in the immediate area;
b. The number of customers likely to be
attracted by the particular use, as
compared to the general category or use
established by this chapter;
c. Whether the proposal will detract from
the possibility of future central
parking lots.
Section 2. A new Subsection E is hereby added to
Section 17.50.070 of the Community Development Code creating
a "parking fund" and providing for its use as follows:
E. Parking Fund. There is hereby created a
special fund to be known as the "parking fund".
All payments made to the City in lieu of construct-
ing off-street parking spaces shall be deposited in
such fund, upon receipt.
The fund shall be used exclusively for projects
intended to provide an appropriate supply of park-
ing spaces in the Downtown Business Area, includ-
ing, though not limited to, acquisition, design,
construction, development and enhancement of on -
and/or off-street parking facilities. The fund may
also be used for payment of general or limited

obligation bonds, off-street parking revenue bonds,
and for the acquisition of property by condemna-
tion, purchase or lease for such parking facilities
and for other expenses and costs incident thereto.
Section 3. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
