ORDINANCE NO. 2.319
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 2.05.030 OF THE
EDMONDS CITY CODE REVISING CERTAIN COMPEN-
SATION PROVISIONS FOR LEGAL SERVICES
PROVIDED BY THE CITY ATTORNEY.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 2.05.030 of the Edmonds City
Code is hereby amended to adjust the rates at which the City
Attorney is compensated for services rendered in the forma-
tion of local improvement districts, as follows:
2.05.030 COMPENSATION
The City Attorney shall receive a salary and main-
tenance and operation expense in such amounts as
the City Council establishes by ordinance adopting
the annual city budget and salary ordinance. The
compensation paid by the city as fixed from time
to time by ordinance shall be payment to the City
Attorney for all legal services performed in con-
nection with or having to do with regular city
operations; provided, however, this shall not
include representing the City of Edmonds in any
superior court action, nor preparation therefore,
for any criminal prosecutions, nor preparation
therefore, nor shall the salary include legal
services rendered in the acquisition of property
or services, or negotiations with third parties.
It is further provided that the City Attorney
shall be paid a regular fee for all local improve-
ment districts, computed at the rate of three
percent of the first fifty thousand dollars
($50,000) of the construction cost of such
improvement, two percent of construction costs in
excess of fifty thousand dollars ($50,000) but not
more than one hundred thousand dollars ($100,000),
one percent of construction costs in excess of one
hundred thousand dollars ($100,000) but not more
than five hundred thousand dollars ($500,000) and
one-half of one percent, or as otherwise
negotiated by the City Council, of construction
costs in excess of five hundred thousand dollars
($500,000), for each such district.
It is further provided, however, that there
shall be a minimum legal charge for any local
improvement district of not less than four hundred
dollars ($400).
As used in this section, "construction costs"
shall include all costs of labor, materials, and
other direct costs and shall exclude the cost of
engineering, interest, advertising and other
indirect costs of the improvement.
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting
as provided by law.
