ORDINANCE N0. 2340
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTION 2.35.040 OF THE
EDMONDS CITY CODE TO AUTHORIZE COMPENSATING
TIME FOR NON-EXEMPT, NON -REPRESENTED EMPLOYEES
AT ONE AND ONE-HALF TIMES THE OVERTIME WORKED,
LIMITING THE AMOUNT OF COMPENSATING TIME THAT
CAN BE ACCUMULATED, AND SPECIFYING THE TIME
WITHIN WHICH IT MUST BE USED.
WHEREAS, current City Codes authorize an employee
compensating time off for hours worked beyond regular hours under
certain specified conditions, and
WHEREAS, the City has entered into an agreement between
the Service Employees International Union No. 6 which provides,
among other things, that employees covered by this agreement may
receive compensating time off at one and one-half times the
overtime worked, and
WHEREAS, in the interest of equity the City Council of
the City of Edmonds has determined that those non-exempt and non -
represented employees who are not covered by the terms of the
collective bargaining agreement should receive a similar
compensating time off allowance subject to the restrictions
imposed in this ordinance, now, therefore
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 2.35.040 of the Edmonds City Code
is hereby amended to read as follows:
"2.35.040 COMPENSATING TIME
When work beyond regular hours for any employee,
including department heads and assistant department
heads, is required of an employee by the City,
compensating time off may be allowed as City
requirements will permit and subject to the following
requirements:
1. Non-exempt and non -represented employees may
be allowed compensating time off at one and
one-half times the overtime worked; provided
that such employee may not accumulate more
than 40 hours of compensating time and that
any compensating time off earned in any
calendar quarter, but not taken by the end of
that quarter, must be taken by the end of the
next calendar quarter.
2. All employees other than specified in
Section 1 above, shall be allowed
compensating time off equal to the amount of
overtime worked. The compensating time off
must be used within the twelve month period
following the date of overtime worked.
3. Compensating time shall be taken at the
convenience of the City. All compensating
time must be approved by the employees
supervisor."
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
