AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, VACATING CERTAIN PROPERTY IN THE
CITY OF EDMONDS, WASHINGTON DEDICATED FOR
STREET PURPOSES BEING A PORTION OF CASPERS
STREET BETWEEN SECOND AVENUE NORTH AND THE
BURLINGTON NORTHERN RIGHT OF WAY AS SET
FORTH IN CITY FILE DESIGNATION ST-5-82;
AMENDING THE OFFICIAL STREET MAP; AND
RETAINING A VIEW EASEMENT OVER THE AREA
VACATED AND OTHER PROPERTY;
WHEREAS, the Hearing Examiner has held a public
hearing and has forwarded his recommendations to the City
Council regarding the proposed street vacation and street map
amendment, and
WHEREAS, pursuant to resolution, the City Council of
the City of Edmonds, Washington, held a public hearing on
December 7, 1982, to consider the proposed vacation of cer-
tain property in the City of Edmonds, Washington, being a
portion of Caspers Street between Second Avenue North and the
Burlington Northern right of wayand more particularly
described as set forth on Exhibits A and B attached hereto
and incorporated in full by this reference, and
WHEREAS, pursuant to the findings of the City's
responsible official, the City Council finds that there will
be no significant adverse environmental impacts, and
WHEREAS, at the conclusion of said public hearing
the City Council found that it is the best interest of the
public health, safety and general welfare that said property
dedicated for street purposes should be vacated and the City

Council does hereby determine to vacate the same as herein-
after set forth, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. The following parcels of property, pre-
viously dedicated for street purposes are hereby vacated.
Said parcels are located in the City of Edmonds, Snohomish
County, Washington, and legally described as set forth on
Exhibits A and B attached hereto and incorporated herein by
this reference as if set forth in full.
Section 2. The City Clerk is hereby directed to
file a certified copy of this ordinance with the Snohomish
County Auditor.
Section 3. The City Engineer is hereby directed to
amend the official street map, adopted by §18.50.010 of the
Community Development Code, as amended, to be consistent with
this ordinance.
Section 4. The City of Edmonds shall retain a view
easement over the property being vacated and set forth on
Exhibits "A" & "B" of this ordinance, as well as adjoining
property. The form of the view easement shall be approved by
the City Attorney and recorded prior to publication and re-
cording of this ordinance.

Section 5. This ordinance shall be in full force and effect
five (5) days after passage and publication by posting as
provided by law.

Lot 1, a distance of 981.70 feet; thence N 0 03100" E, a dis-
tance of 15.00 feet to the True Point of Beginning of this
description; thence con8inuing N 0003100" E, a distance of
15.00 feet; thence N 8920100" W, parallel with the south
line of said Government Lot 1, to an intersection with a line
drawn parallel with and 37.50 feet southeasterly from the
