ORDINANCE NO. 2348
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, ADDING A NEW SECTION 8.04.150 TO
THE EDMONDS CITY CODE DEFINING THE TERM
"BUSINESS DISTRICT" FOR THE PURPOSES OF
PEDESTRIAN CROSSINGS PROHIBITED BY RCW
46.90.418.
WHEREAS, it is in the public health, safety and
general welfare to restrict pedestrian crossing of streets at
points other than at crosswalks in areas where there is a
substantial volume of traffic, retail businesses and public
facilities, and
WHEREAS, the Edmonds City Code has adopted RCW
46.90.418 by reference, which prohibits pedestrian crossing
in business districts except at marked crosswalks, and
WHEREAS, the City Council finds that certain streets
in Edmonds should be defined as business districts for the
purpose of such statute, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A new Section 8.04.150 is hereby added
to the Edmonds City Code to read as follows:
8.04.150 Business District
For the purposes of RCW 46.90.418, prohibiting
pedestrian crossing of streets in business districts
other than at crosswalks, "business district" shall
include the following streets provided crosswalks
are clearly marked on such streets by signs or
painted street markings, or signs are erected
prohibiting pedestrian crossings:
A. Central traffic district as defined by this
chapter;
B. 212th Street S.W. between the intersections of
74th Avenue West and 80th Avenue West;
C. 76th Avenue West between the intersections of
218th Street S.W. and 203rd Street S.W.; and
D. All other portions of streets that at the
discretion of the Traffic Engineer, have a sub-
stantial volume of traffic and along which there
are retail businesses and/or public facilities
such as schools, libraries and recreation
centers thereby creating a significant risk of
hazard and a strong likelihood of pedestrian
crossings.
Section 2. If any section, sentence, clause, phrase
or word of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the valid-
ity or constitutionality of any other section, sentence,
clause, phrase or word of this ordinance.
Section 3. The Traffic Engineer is hereby directed
to erect signs prohibiting pedestrian crossings and/or
marking crosswalks consistent with this ordinance.
Section 4. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
