ORDINANCE NO. 2356
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 3.07.010 OF THE EDMONDS CITY CODE
REGARDING THE CRIMINAL INVESTIGATION CONTINGENCY
FUND.
WHEREAS, from time to time the City of Edmonds has
received and expects to continue to receive monies pursuant to
court order for the general purpose of drug enforcement, and
the specific purpose of conducting "drug buys", and
WHEREAS, the City Council finds that such court ordered
funds should be adequately available to the Edmonds Police
Department for the control of the illegal use of dangerous
drugs and controlled substances, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 3.07.010 of the Edmonds City Code
is hereby amended to read as follows:
3.07.010 CONTINGENCY FUND, CRIMINAL INVESTIGATIONS
There is created a revolving contingency fund to provide monies
for the purpose of surveillance, prevention, investigation and
apprehension of violations of law, including the illicit sale,
distribution and use of narcotics or dangerous drugs or
controlled substances. Expenditures from the fund shall be
upon request of the chief or assistant chief of the Edmonds
police department, and subject to the approval of the mayor,
for the purposes set forth herein. The contingency fund shall
be a revolving fund in an amount not to exceed two hundred
fifty dollars and shall be funded by transfer from available
funds by the city finance director subject to the approval of
the mayor.
In addition to the amount budgeted for such revolving fund,
there shall be deposited into the Criminal Investigation
Contingency Fund any and all monies received by the city
pursuant to a court order prescribing that such monies are to
be used for "drug buys", or any other activity in the
enforcement of laws prohibiting the sale, distribution or use
of narcotics, dangerous drugs or controlled substances. Such
monies shall be available to the police department in manner
set forth above.
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting
as provided by law.
