ORDINANCE NO. 2379
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTIONS 20.75.040 OF THE
COMMUNITY DEVELOPMENT CODE TO PROVIDE FOR
CONCURRENT PROCESSING OF SUBDIVISION
APPLICATIONS WITH OTHER APPLICATIONS FOR
PERMITS AND APPROVALS; AMENDING SECTION
20.75.065(B)(1)(a) TO PROVIDE POSTING OF
NOTICES OF PROPOSED SUBDIVISIONS ON ADJACENT
PROPERTIES; AMENDING SECTION 20.75.100 TO
PROVIDE THREE YEARS FOR FILING OF A FINAL
PLAT; AND AMENDING SECTION 20.75.105 TO SET
FORTH THE PROCEDURE FOR GRANTING TIME
EXTENSIONS FOR FILING FINAL PLATS.
WHEREAS, the City Council intends to amend Chapter
20.75 of the Community Development Code, concerning subdivision
approval, thereby bringing such ordinance into conformance with
changes in state law, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 20.75.040 of the Community
Development Code shall be amended to read as follows:
20.75.040 APPLICATION
Applications for subdivisions shall be made to the Community
Development Director on forms provided by the Community
Development Department. A subdivision application will be
processed concurrently with any applications for rezones,
variances, planned unit developments, site plan approvals and
other similar approvals, that relate to the proposed subdivi-
sion, unless the applicant expressly requests sequential pro-
cessing. The application shall contain the following items in
addition to those specified in Section 20.75.010.
A. A reproducible copy of the preliminary plat and the number
of prints required by the Community Development
Department.
B. Title report.
C. A survey map, if required by the Community Development
Director, of the exterior boundaries of the land to be
subdivided, prepared by, and bearing the seal and signa-
ture of, a professional land surveyor registered in the
State of Washington. This map can be combined with the
preliminary plat at the applicant's option.
D. The application fee as set in Chapter 15.00.
E. A proposal for dedication of park land rather than payment
of "in -lieu" fees, if desired by the applicant.
F. Source of water supply and name of supplier.
G. Method of sewage disposal, and name of municipal system if
applicable. Percolation rates and other information
required by the Public Works Department shall be submitted
if septic tanks are to be used.
H. Other information that may be required by the Community
Development Director in order to properly review the pro-
posed subdivision, including information needed to deter-
mine the environmental impact of the proposal.
Section 2. Section 20.75.065(B)(1)(a) of the
Community Development Code is hereby amended to read as
follows:
a. One publication in a newspaper of general
circulation within Snohomish County pursuant to
Chapter 1.03 of the Edmonds City Code and
posting notice in three conspicuous places
within three .hundred feet of any portion of the
boundary of the proposed formal subdivision not
less than ten days prior to the hearing.
Section 3. Section 20.75.100 of the Community
Development Code is hereby amended to read as follows:
20.75.100 PRELIMINARY APPROVAL - TIME LIMIT
A preliminary approval of a subdivision or lot line adjustment
will expire and have no further validity at the end of three
years, unless the applicant has obtained approval of the final
plat or has filed an application to extend the time at least
thirty days before the approval expires. The period runs from

the date of preliminary approval. A properly filed application
for an extension of time extends the time limit until the city
has acted on the application, but the subdivision or lot line
adjustment may not be filed for record during the period
between the original expiration date and the date the city acts
on the extension request.
Section 4. Section 20.75.105 of the Community
Development Code is hereby amended to read as follows:
20.75.105 EXTENSIONS OF TIME
Applications for extensions of time on any preliminary approval
shall be filed in writing with the Community Development
Director, along with the application fee as set in Chapter
15.00 at least thirty days before the expiration of three years
from the date of preliminary plat approval. The Community
Development Director may approve one one-year extension, by
making written findings that there is no substantial change in
the proposal, that the findings and conclusions of the original
approval still apply, under the procedure of Section 20.95.050
(Staff Decision - Optional Hearing), and that the applicant has
made a good faith attempt to submit the final plat within the
three year period.
Section 5. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or unconstitu-
tional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitu-
tionality of any other section, sentence, clause or phrase of
this ordinance.

Section 6. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting
as provided by law.
