ORDINANCE NO. 2385
AN ORDINANCE OF THE CITY OF EDMONDS, WASHING -
TON, AMENDING SECTION 5.35.240 DESIGNATING A
PORTION OF SUNSET AVENUE A QUIET ZONE PURSUANT
TO SECTION 5.35.200-230 OF THE EDMONDS CITY
CODE.
WHEREAS, the City Council of the City of Edmonds
passed Ordinance No. 2372 on June 21, 1983, adopting a
procedure for the establishment of quiet zones in the city in
which certain conduct described in Section 4 of that
ordinance and Section 5.35.230 of the Edmonds City Code are
prohibited when such area is properly posted pursuant to
Section 3 of the ordinance and Section 5.35.220, and
WHEREAS, a petition signed by persons from fifteen
different residences located along a section of Sunset Avenue
North between Edmonds Street and Casper Street was filed with
the city and
WHEREAS, a public hearing was held on July 19, 1983,
after notice was given in the manner prescribed for hearing a
proposed rezone, and
WHEREAS, after all members of the public who wished
to give testimony had done so and the public hearing was
closed, the City Council made the following findings:
1. That disturbing noise in the subject area originates
from multiple sources.
2. That such noise is prevalent with substantial
frequency during any 30-day period and there is a
high likelihood of reoccurence.
3. That the source of the noise is transient in that it
originates from portable sources such as car stereos
and the like which move into and out of the
neighborhood.
4. That the subject noise is generated from locations on
the subject portion of Sunset Avenue, a public
street, and from the property on the west side of
Sunset Avenue which is open for public use, and which
public property is immediately adjacent to a
residential district located on the east side of
Sunset Avenue, and
WHEREAS, the City Council finds that it is in the
interest of the public health, safety and general welfare
that the portion of Sunset Avenue North between Edmonds
Street and Casper Street be designated a quiet zone, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 5.35.240 is hereby amended to
read as follows:
5.35.240 SCHEDULE OF QUIET ZONES
In accordance with the provisions of this chapter and when
signs are erected giving notice thereof, no person shall at
any time commit any act proscribed by Section 5.35.230 of the
City Code in any of the following described Quiet Zones:

1. Sunset Avenue North, from Edmonds Street to Casper
Street.
Section 2. The City Engineer is directed to erect
signs in conspicuous locations along Sunset Avenue North
between Edmonds Street and Casper Street stating: "Quiet
Zone, use of radios, tape players, musical instruments and
similar devices prohibited if audible over 30 feet away."

Section 3. This ordinance shall be in full force and
effect five (5) days after passage and publication as
provided by law.
