ORDINANCE NO. 2414
AN ORDINANCE OF THE CITY OF EDMONDS, WASHING -
TON, AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF EDMONDS TO CHANGE THE ZONING DESIGNA-
TION ON CERTAIN REAL PROPERTY COMMONLY KNOWN
AS THE LaPIERRE REZONE, FILE NO. R-6-83 FROM
CG(GENERAL COMMERCIAL) LIMITED TO COMMERCIAL/
OFFICE USES TO CG LIMITED TO MULTI -FAMILY RE-
SIDENTIAL, RETAIL AND OFFICE USES; AUTHORIZING
EXECUTION OF AN AMENDMENT TO A CONCOMITANT
ZONING AGREEMENT AND ESTABLISHING AN EFFEC-
TIVE DATE.
WHEREAS, the planning Board at a public hearing held
on September 14, 1983, considered,the following amendments to
the official zoning map and the existing concomitant zoning
agreement, R-4-81 and made their findings and recommendations
which were forwarded to the City Council, and
WHEREAS, the City Council at a public meeting reviewed
the recommendations of the Planning Board and determined that
the proposed amendment to contract rezone R-4-81 should be
approved and adopting the Planning Board's findings and con-
clusions, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. The official zoning map of the City of
Edmonds, as adopted by Section 17.00.010 of the Edmonds
Community Development Code is hereby amended by changing the
zoning classification of certain property hereinafter
described from CG (General Commercial) limited to commercial/
office uses to CG limited to multi -family residential, retail
and office uses subject to the Amendment to Concomitant Zoning
Agreement R-4-81 executed and recorded as provided herein. The
legal description of the property rezoned is set forth in
Exhibit A attached hereto and incorporated herein by this ref-
erence as if set forth in full.
Section 2. The Planning Director is hereby instructed
to effectuate the necessary amendments to the official zoning
map of the City of Edmonds pursuant to this ordinance.
Section 3. The Mayor is hereby authorized to execute
and the City Clerk to attest to that certain document enti-
tled "Agreement and Covenants in The Nature of a Contract
Rezone" amending the Concomitant Zoning Agreement R-4-81.
The City Clerk is further directed to record said Concomitant
Zoning Agreement with the Snohomish County Auditor as a cove-
nant running with the land. The cost of said recordation shall
be paid by the owners.
Section 4. This ordinance shall be in full force and
effect five (5) days after publication and posting as provided
by law.

All of Tract 3 and that portion of Tract 2, Solner's Five Acre
Tracts according to the plat thereof recorded in Volume 7 of Plats
on page 25, records of Snohomish County, Washington, lying southerly
and easterly of a line which begins at a point on the north line of
Tract 2, S 88052'14" E 585.00 feet from the northwest corner of Lot 3
of Forshee's Upland Tracts according to the plat thereof recorded in
Volume 13 of Plats on page 57, records of said County; thence
S 00 25' 10" W, parallel with the west line of said Tract 2, a
distance of 12.5.00 feet; thence S 690 28' 51" W. 291.38 feet to the
west line of said Tract 2 at the southeast corner of Lot 1 of said
Forshee's Upland Tracts and the terminus of the line herein described;
