ORDINANCE NO. 2476
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
VACATING CERTAIN UNIMPROVED RIGHT OF WAY OF 104TH
AVENUE WEST AND FIXING A TIME WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, pursuant to Resolution No. 605, the City
Council of the City of Edmonds, Washington, held a public
hearing to consider the proposed vacation of unimproved right of
way of 104th Avenue West, lying south of 228th St. S.W. and East
of the Sherwood Elementary School in the City of Edmonds,
Washington, and
WHEREAS, pursuant to the findings of the City's
responsible official, the City Council finds that there will be
no significant adverse environmental impacts, and
WHEREAS, the Council found at the conclusion of said
public hearing that the property previously dedicated for street
purposes was without value to the City and that the value of
such property was and will be exceeded by the costs of the
dedication and recording procedure and therefore finds that the
property should be vacated without the payment of any sum, and
WHEREAS, the City Council does therefore determine to
vacate the property as herein set forth, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the following described easement
previously dedicated for street purposes is hereby vacated.
Said easement is located within the City of Edmonds, Snohomish
County, Washington, and is described as the unimproved right of
way of 104th Avenue West, lying south of 228th Street S.W. and
East of Sherwood Elementary School, as shown and legally
described on Exhibits A and B attached hereto and incorporated
by this reference as if fully herein set forth.
Section 2. The City Clerk is hereby directed to file a
certified copy of this ordinance with the Snohomish County
Auditor.
Section 3. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
