There is a Category II Wetland on the western portion of the property. The wetland has a 165-foot buffer associated with it. The buffer extends across the eastern portion of the property and off site to the property to the east. As a result, the property is completely encumbered by critical areas and subject to the Reasonable Use Exception process of ECDC 23.40.210 Variances. Due to the unique circumstance of the property, any development on the property would be on the eastern portion of the property. Regardless of the size of the development, future development would take into consideration the location of the existing sewer easement and the access point off of 2nd Ave W. As a result, the development would be centrally located on the property, resulting in the isolation of any protective buffer east of the proposed development. List of Questions 1. Has the city established written policy on what "Reasonable Economic Use" other than the definition found in ECDC 23.40.005? 2. Was there any buffer reduction or mitigation plan associated with the existing sewer line that would benefit or assist in the reduction of the 165' buffer? 3. Do the improvements on the adjacent property to the south, set a precedence in establishing acceptable impacts to the wetland? 4. Will the city take into consideration the existing zoning designation when establishing reasonable economic use?
