INTRODUCTION The subject application is for an Accessory Dwelling Unit (ADU) to be established within the existing single family residence located at 220 71h Ave. N. The site is located within the Single -Family Residential, RS-6 zone (Attachment 5). The land use application and project description from the applicant is included as Attachment 1. During the course of the review of the proposed ADU the property has been sold to a new owner. The new owner has included a statement which is included as Attachment 12. The application materials includes, an ADU affidavit from the applicant and new owner (Attachment 2 and 13), a floor plan (Attachment 3) and elevation views (Attachment 4). Approval of an ADU requires compliance with Edmonds Community Development Code (ECDC) Chapters 16.20 and 20.21. Pursuant to ECDC 20.01, an ADU is a Type II decision requiring public notice. B. COMPLIANCE WITH ECDC CHAPTER 16.20 The subject site is located within the Single -Family Residential, RS-6 zone (Attachment 5). The purposes of the RS — Single -Family Residential zones are to reserve and regulate areas primarily for family living in single-family dwellings and to provide for additional non-residential uses which complement and are compatible with a single-family dwelling use. Pursuant to ECDC 16.20.010(D), an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit. The proposal is required to comply with the purposes of the single-family residential zone and the criteria outlined in Chapter 20.21. Based on staff's review of the specific ADU criteria (as described in Section C of this report), staff finds that the proposal is in compliance with the purposes of the single-family zone. COMPLIANCE WITH ECDC CHAPTER 20.21 Section 20.21.030 of the Edmonds Community Development Code (ECDC) provides the criteria by which Accessory Dwelling Units (ADUs) are to be reviewed. In order for the permit to be approved, all of the criteria must be met. The criteria for approval are as follows: (1) Land Use Permit; (2) Number of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light, Ventilation, Floor Area, and Similar Factors. The ADU criteria were crafted to ensure that ADUs would comply with Chapter 16.20 of the Edmonds Community Development Code. Detailed explanations of staff's review of each criteria follows. 1. Land Use Permit Required Permit Required. Any person who occupies or permits another person to occupy an attached accessory dwelling unit as a place of residence shall first obtain a permit. The permit shall be reviewed and processed as a Type 11 decision (Staff decision — Notice required). An application for a land use permit for the subject ADU was submitted to the City on June 29, 2020 (Attachment 1). A letter of in -complete application was sent to the applicant on July 17, 2020 and the applicant submitted the requested information on July 20, 2020. The application became procedurally complete on July 21, 2020 pursuant to ECDC 20.02.002 (Attachment 6). A letter requesting additional information was sent to the applicant on July 21, 2020 (Attachment 6). The applicant submitted the requested information on July 28, 2020, and a request for further clarification was requested on August 18, 2020 (Attachment 7). The applicant responded to the request for information on October 19th and October 26th and the new property owner also provided a response on October 22"d (Attachments 12). Number of Units Number of Units. A single-family dwelling may have no more than one accessory dwelling unit per lot. The proposal will result in only one ADU. There had been concern that the existing home could be potentially set up to accommodate additional ADUs. Per the new owners response received on October 22"d (Attachment 12) it has been confirmed that the home will include two kitchens, one on the second floor of the main living area and one downstairs in the ADU. The proposed ADU will be located on the main floor adjacent to the garage (Attachment 3). The proposal will result in only one ADU and therefore is in compliance with the number of units allowed per ECDC 20.21.030(B). 3. Size Size. In no case shall an accessory dwelling unit be (1) larger than 40 percent of the livable floor area of the principal dwelling, (2) nor more than 800 square feet, (3) nor have more than two bedrooms; provided, if the accessory dwelling unit is completely located on a single floor, the planning manager may allow increased size up to 50 percent of the floor area of the principal dwelling in order to efficiently use all floor area, so long as all other standards set forth in this chapter are met. The floor plan of the proposed ADU is included as Attachment 3. The ADU is proposed to encompass approximately 780 square feet, while the existing single family contains approximately 2,876 square feet. With the area of the main residence and the proposed ADU, this yields a total livable area for the residence of 3,656 square feet. The proposed ADU (780 File No. PLN2020-0036 Stojkovic ADU Page 3 of 7 square feet) would comprise 21.3% of the total livable floor area (3,656 square feet) of the primary dwelling. The following table describes both the maximum size that Accessory Dwelling Units are allowed to be as well as the proposed size for this application: Maximum Allowed Proposed 40% of livable area of the primary dwelling 21.3% of livable area of the primary dwelling 2 bedrooms 1 bedroom 800 square feet 780 square feet The applicant is requesting approval of an ADU that is less than 40 percent of the livable area of the residence, no more than two bedrooms, and no more than 800 square feet in size. Therefore, staff has determined that the application meets the size criteria. 4. Location and Appearance The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be incorporated into the design of the principal dwelling unit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single-family residence using matching materials, colors, window style, and roof design. The primary entrance to the accessory dwelling unit shall be located in such a manner as to be unobtrusive when viewed from the street. Whenever possible, new entrances should be placed at the side or rear of the building. Only one electric and one water meter shall be allowed for the entire building, serving both the primary residence and the accessory dwelling unit. Accessory dwelling units must be located within or attached to single-family dwelling units. The existing residence and proposed ADU is located on the south side of Edmonds St., and east of 71h Ave. N. (Attachment 5). The proposed ADU is located in the main level of the single family dwelling with existing ingress/egress access to the ADU. The existing access is setback from the street and screened with fencing and landscaping. No new entrances are proposed and thus should not draw additional attention to the residence as containing an ADU. Staff finds that because the proposed ADU is located within the existing single family residence it will continue to maintain the architectural design, style, appearance, and character of the existing building and would not compromise the single-family appearance of the residence; therefore, the subject application complies with the location and appearance criteria. 5. Parking Parking. One off-street parking space in addition to the parking spaces normally required for the principal dwelling shall be required to be provided for the accessory dwelling unit, but in no event less than three spaces per lot. As depicted on the floor plan (Attachment 3), at least three vehicles can be provided for on site, the applicant has shown compliance with the applicable on -site parking requirements of ECDC 17.50.020(A)(1) and ECDC 20.21.030(E), and staff finds that parking for at least three vehicles can be provided for on site. 6. Occupancy Occupancy. Either the primary dwelling or the accessory dwelling unit shall be owner -occupied. "Owner -occupied" shall mean a property owner who makes his or her legal residence at the site, as evidenced by voter registration, vehicle registration, or similar means, and actually resides at the site more than six months out of any given year, and at no time receives rent for the owner- File No. PLN2020-0036 Stojkovic ADU Page 4 of 7 occupied unit. The owner(s) shall not rent the designated owner -occupied unit at any time during the pendency of the ADU permit; any such rental shall void the permit. The owner(s) shall not rent any portion of the owner -occupied residence either during the owner(s)' occupancy or while the owner is absent from the owner -occupied unit for any period. In no event shall the total number of occupants exceed one family as defined in this code; provided, however, that if the accessory dwelling unit is occupied by a nurse or other caregiver assisting a disabled person who is an occupant of the principal residence, or the principal residence is occupied by a nurs%aregiver and the accessory dwelling unit is occupied by a disabled person under the nurse's care, the occupancy limit of one family may be increased by one additional unrelated person to a total of one family related by genetics, adoption or marriage plus one unrelated person, or a total of six unrelated persons. In no event shall the total number of occupants exceed one family as defined in this code. The applicant/property owner has submitted a notarized affidavit to the City confirming that they will reside in the primary residence or ADU for more than six months of every year (Attachment 2 and 13). The property owner must also file the required covenant with the County Auditor following approval of the ADU, which has been added as a condition of approval. This covenant will be provided to the applicant for a signature and recording during the required building/compliance permit application review. 7. Safety, Light, Ventilation, Floor Area, and Similar Factors Safety, Light, Ventilation, Floor Area and Similar Factors. Accessory dwelling units shall comply with all applicable requirements of the Uniform Housing Code and the Uniform Building Code adopted by ECDC Title 19 and shall comply in all respects with the provisions of the Edmonds Community Development Code. No permit for an accessory dwelling unit shall be issued to a nonconforming structure unless that structure is brought into conformance with the then current provisions of this code. The applicant is required to apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. Any conditions or corrections resulting from the inspection must be complied with per code requirements. Any approval of an ADU shall be conditioned to require compliance with the Building Division's inspection requirements. This has been made a condition of approval for the subject ADU permit. D. TECHNICAL REVIEW The subject proposal has been reviewed by the Building Division, Engineering Division, and Snohomish County Fire District No. 1. The Building Division did offer preliminary building code review comments on the proposal and the comments are included as Attachment 8. The Engineering Division provided a memorandum confirming that the application is consistent with Title 18 ECDC and Engineering standards, which includes parking requirements (Attachment 9). Snohomish County Fire District No. 1 had no comments on the proposal. Affected divisions/departments may have additional comments related to the proposal as part of their respective reviews of any associated building permit application(s). E. PUBLIC COMMENTS In accordance with ECDC 20.03, a "Notice of Application" dated July 30, 2020 with a comment period ending on August 13, 2020 was mailed to property owners within 300 feet of the subject site and was posted on the site on July 30, 2020. The notice of application was also published in the File No. PLN2020-0036 Stojkovic ADU Page 5 of 7 Herald Newspaper on July 30, 2020. All public notice materials, including the notice, declarations of mailing and posting, and an affidavit of publication are included as documents of compliance with the public notice requirements of ECDC 20.03 (Attachment 10). Four public comment letters have been received during the comment period and are included as Attachment 11. Beth Whitney: Has expressed concerns and requested that staff hold off on issuing a decision for the requested ADU at this time so that new policies may be considered regarding how ADU's may impact housing in Edmond and the needs and options of the community. She believes it may be premature to issue a decision prior to further consideration by the commission, council and staff. Dan and Suzanne Neilsen: Have expressed concerns with approval of the ADU within a single family zone with the understanding that Accessory Dwelling Units were prohibited in this zone. Additionally, Mrs. Neilsen has concern regarding how the ADU was approved in the original house plans without public notification and is concerned regarding the number of units permitted. Karen Scholl: Has expressed concerns regarding approval of an ADU stating that ADU's are rarely permitted in the Edmonds bowl area. Patricia Gow: Has expressed concerns regarding approval of the ADU and believes that the home should remain as a single family residence (zoned RS-6). Ms. Gow has stated that she is opposed to approval of the ADU. STAFF RESPONSE: The purposes of the RS — Single -Family Residential zones are to reserve and regulate areas primarily for family living in single-family dwellings and to provide for additional non-residential uses which complement and are compatible with a single-family dwelling use. Pursuant to ECDC 16.20.010(D), an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit in the single family residential zone and is not a rezone of the zoning designation. The proposal is required to comply with the purposes of the single-family residential zone and the criteria outlined in Chapter 20.21. Based on staffs review of the specific ADU criteria (as described in Section C of this report), staff finds that the proposal is in compliance with the purposes of the single-family zone. Staff must make a decision based on the current code and criteria and may not hold off on issuing a decision. Pursuant to ECDC 20.02.003.G. after acceptance of an application, the city shall begin processing the application. Under no circumstances shall the city place any application on "hold" to be processed at some later date, even if the request for the "hold" is made by the applicant, and regardless of the requested length of the "holding" period. This subsection does not apply to applications placed on "hold" upon determination by the city that additional information is required in order to make a decision. The applicant/property owner has responded to requests for additional information and as noted in section C of this report staff has found that the ADU complies with the ADU criteria per Chapter 20.21. A building permit for the existing home was submitted in 2011 under file number BLD2011- 0404. As part of the review for the home in 2011 staff had asked the applicant if an ADU was intended and had provided the applicant with information to submit for an ADU application or File No. PLN2020-0036 Stojkovic ADU Page 6 of 7 to clearly label the plans "NOT AN ADU" (attachment 14). Per the approved building permit (attachment 15) under conditions on page 2 it states; "NOT AN ACCESSORY DWELLING UNIT (ADU)", an ADU had not been previously issued for the subject site. Based on staff's review of the specific ADU criteria (as described in Section C of this report), staff finds that the proposal is in compliance with the purposes of the single-family zone. As a condition of approval the applicant/owner is required to apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. Any conditions or corrections resulting from the inspection must be complied with per code requirements. F. DECISION Based on statements of fact, conclusions, and attachments in this report, the application for a Conditional Use Permit for an Accessory Dwelling Unit at 220 7t" Ave. N. is APPROVED, subject to the following conditions: 1. A building permit and/or compliance permit must be obtained from the Building Division and final inspection must be made and occupancy approval granted by the City Building Inspector prior to the area being used as an ADU. Specific comments from the Building Division will be addressed during review of the applicable building/compliance permit application. 2. This permit shall expire automatically if any of the following issues arise: a. The Accessory Dwelling Unit is substantially altered and is thus no longer in conformance with the plans and drawings reviewed and approved by the permitting authority and Building Official. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the Accessory Dwelling Unit, the owner -occupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025(A)(1). 3. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor. This covenant may be obtained from the Planning Division during the associated building/compliance permit application review. Prior to occupancy of the Accessory Dwelling Unit, the applicant must either (fees stated below are based on current fees and are subject to change): Provide the City processing fee ($110) plus the County recording fee (currently $103.50 for one page plus $1 for each additional page), and the City will record the covenant for you; OR Arrange to record the covenant with the County on your own for the County's recording fee (currently $103.50 for one page plus $1 for each additional page), and return a copy of the recorded covenant to the Edmonds Planning Division with the Auditor's recording sticker on the copy. 4. The Accessory Dwelling Unit permit shall not be transferable to any site other than the subject site described in the application. The Accessory Dwelling Unit permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above. This includes the study of ADU's, both attached and detached, and how they impact housing in Edmonds and the needs and opinions of our community. Allowing the conditional use permit is premature while the citizen housing commission is studying ADU's and the best policies for Edmonds in the future. It sets a troubling precedent in a neighborhood where density is already encroaching. Please respect the work of the citizen housing commission and do not issue the conditional use permit until the commission, the city council and city staff have determined the best solutions for the future of Edmonds housing needs.
