ORDINANCE NO. 4233
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, ACCEPTING TITLE TO REAL PROPERTY
THROUGH A PERSONAL REPRESENTATIVE’S DEED FROM
THE ESTATE OF SHIRLEY M. JOHNSON SUBJECT TO
CERTAIN TERMS WHICH ARE DESCRIBED IN THAT DEED.
WHEREAS, Shirley M. Johnson was a long term resident of the City of Edmonds, who
resided at 9309 Bowdoin Way; and
WHEREAS, Shirley M. Johnson’s property consists of 1.14 acres of single family
residential land adjacent to Yost Park; and
WHEREAS, Shirley M. Johnson passed away on January 31, 2021; and
WHEREAS, Shirley M. Johnson wished to leave most of her property, including her real
property, to the City of Edmonds; and
WHEREAS, Section IV of the Last Will and Testament of Shirley Johnson reads as follows:
I hereby give, bequeath and devise all the rest and residue of my estate, both real
and personal, of every kind, nature and description and wheresoever situated, of
which I may die seized or possessed or in which I may have an interest at the time
of my demise, to the CITY OF EDMONDS, and with respect to my real property
at 9309 Bowdoin Way, Edmonds, WA, specifically for purposes of being used as a
park and/or a community garden site and/or to cultivate and grow plants, fruits,
vegetables and other related things all for the City of Edmonds and for the citizens
of Edmonds and the local community as the City of Edmonds deems best in their
discretion.
and
WHEREAS, RCW 35.21.100 states that “Every city and town by ordinance may accept
any money or property donated, devised, or bequeathed to it and carry out the terms of the
donation, devise, or bequest, if within the powers granted by law. If no terms or conditions are
attached to the donation, devise, or bequest, the city or town may expend or use it for any municipal
purpose.”; and
WHEREAS, the city council acknowledges the specified purpose of Shirley M. Johnson in
leaving her property to the City of Edmonds; and
