This Lease between Camwest, Inc as Lessor (herein called "Wall Owner") and the Edmonds Mural Society, as Lessee (herein called the "Society', WITNESS THAT: The Society has a program for expanding public experiences with visual art by placing works of art in public places and in places open to the view of the public; and The Wall Owner desires to participate in such program and to lease to the Society a building wall under its control for the display of a painted mural (hereinafter referred to as the "Work"), that will be open to the view of the public from nearby public rights(s) of way; NOW, THEREFORE, in consideration of the mutual covenants hereinafter contained, the parties hereto agree as follows: Article 1. Lease PropeU The Wall Owner hereby leases to the Society the entire north wall of the building (which space is referred to hereinafter as the "Wall') located at the property described as follows: Addressed 104 Fifth Ave N, Edmonds, Washington. The Society agrees to lease the space described in Article 1 for a sum of One Dollar ($1) per year paid in a lump sum as compensation for the entire term of the lease. Lessor shall be paid by the Society for services related to this Agreement only as provided hereinafter. Such payment shall be in full compensation for use of the Wall as described herein. The total payment is subject to adjustment as set forth in Article 3a. Total payment shall be made as set forth below: Payment $5 Within ten (10) days of the execution of the agreement Article 3. Duration. The Wall Owner may terminate this lease upon thirty (30) days written notice to the Society due to actual needs of the building for reconstruction purposes or to erect a structure that restricts or obstructs the view of the Work or if sale of the building is jeopardized by having the agreement in place. b. The Wall Owner agrees not to post signs or posters of any kind on the same wall as the Work. c. The Society is responsible for all routine cleaning, maintenance and/or repair of the Work. d. Nova Color Artists Acrylic Paints has been made in Culverton, CA since the 1960s. Nova employs a tough, durable, 100% acrylic resin suitable for use outdoors. No additives are needed for exterior use. (By way of contrast: House paints or craft paints are often made with a less expensive and less durable latex or vinyl latex resin, designed to last 5-10 years before recoating.) The American Society for Testing and Materials (ASTM) standard D5098 rates the lightfastness of pigments (ie resistance to fading). Lightfastness I is the highest rating, and the majority of colors to be used in painting of this mural are rated I. In addition, the clear topcoat Nova Color #216 Exterior Varnish or Nova Color #206 Gloss Medium & Varnish designed for exterior use by Nova will be applied to the completed mural to protect against dampness, fading due to UV rays or weather damage Nova Color Artists Acrylic Paints conform with federal art material labeling guidelines and have been reviewed by a toxicologist. All colors except the cadmium colors (rarely used in murals) are labeled as follows: No health hazard labeling required. Labeling conforms with ASTM D-4236. At that time, by the date the artist submitted the design, its development was complete. Fabrication: This mural is being painted on the north wall of 104 Fifth Avenue. Therefore, there is little fabrication occurring. Instead, the wall will be pressure -washed the week of July 8 - July 14. A coat of primer will be applied early in the week of August 12 - August 18. The mural itself, weather permitting, shall be painted during the week of August 19 - August 31. If the weather is not appropriate for the painting of the mural during this week, the Edmonds Mural Society will make arrangements for the painting of the mural on a following week. Completion: During the week following the painting of the mural, it shall be coated with a UV - protective sealant to minimize fading, dampness, or weather damage over the years. RF-nF.'NjF_ SUN I niz DEVELOI) MUN S RVIM Maintenance Requirements for Proposed Mural Winter Walk by Susan Babcock (104 Fifth Avenue South) This mural shall be painted on a building wall that has been leased by written contract for a length of ten years, with an option to renew. The Edmonds Mural Society, by contract with the landowner, is responsible for all maintenance and upkeep for this mural during the time specified by the contract. The Edmonds Mural Society shall maintain this mural in the following manner: This mural shall be mounted in keeping with the finest methods of mural creation to date. In specific, the wall shall be pressure -washed at least two weeks in advance of the mural raising. Second, before mounting the mural, a layer of primer shall be applied to the wall surface area. Finally, following completion of the mural, it shall be treated with a UV - protective sealant to minimize fading or weather damage over the years. The two main sources of damage to a mural are sunlight and dampness. Each spring, this mural shall be examined thoroughly for signs of fading due to ultra -violet rays or dampness or weather damage. Any such damage will be immediately repaired in consultation with artists hired by the Board of the Edmonds Mural Society. On a final note, the Edmonds Mural Society is often asked about protecting murals from vandalism, specifically "tagging." Surprisingly, the wealth of experience of mural societies across the country all agree: tagging of murals is not a serious concern. It almost never occurs. Then, too, on those rare occasions that tagging does occur, mural societies have uniformly found that cost of repairs is relatively cheap. (Quite simply, they paint over the tagging.) Moreover, all the mural societies that we asked agreed that while there are anti -tagging products available on the market, they are so expensive that their purchase is not justified when repairs to the rare mural tagged are so inexpensively, and quickly, carried out. SECEIVE® n IN 11 2W ®EVELOpCMO NT SERVICES Description and Summary for Proposed Mural Winter Walk by Susan Babcock (104 Fifth Avenue) I have been admiring the murals in Edmonds since moving here almost three years ago, and have thought of entering a design for mural consideration for the past two years. The theme of An Edmonds Kind of Day caught my imagination. During the recent snowstorm, I was pleased to see so many people out and about, enjoying the beautiful snowy days, sledding, skiing, playing with their children and remarking how different everything seemed covered in fresh snow. This gave me an idea for a mural that seemed to be different than the current murals on display: a winter scene placed in a well-known Edmonds landmark, with people enjoying the wonder of a snowstorm, The waterfront part with its view of the ferry, the breakwater and the harbor seemed ideal. I walk there often and always enjoy the surroundings, the strollers and the families that I see there. The concept seemed to lend itself to a vertical rather an a horizontal framework. The Comprehensive Plan identifies two the sites as Downtown/Waterfront Activity Center — Retail Core (313 Main Street and 104 - 5d' Ave. N); the other site (504 — 5`h Ave S) is also within the Page 1 of 3 Downtown/Waterfront Activity Center with a comprehensive plan designation of Downtown Mixed Commercial. The murals satisfies the intent of ECDC 22.43, specifically treating blank walls, as well as the following goals and policies from the Comprehensive Plan: a. Downtown Design Objectives are found on pages 56-60 and are intended to encourage high quality, well designed projects to be developed in the downtown waterfront area that reflect the values of the citizens of Edmonds. b. "Improve pedestrian access and way -finding by providing a variety in building forms, color, materials and individuality of buildings" (page 57). c. "Art should be integrated into the design of both public and private developments, with incentives provided to encourage these elements" (page 58). d. "Public art and amenities such as mini parks, flower baskets, street furniture, etc., should be provided as a normal part of the public streetscape. Whenever possible, these elements should be continued in the portion of the private streetscape that adjoins the public streetscape" (page 58). 3. Sign type. The murals are considered wall graphics and wall graphics are conditionally permitted sign types in the downtown business area. Review criteria for murals are contained within ECDC 20.60.010.C.3: a. Quality of the materials used to create the artwork. Materials should be resistant to fading; no fluorescent paints: All three murals will be painted using Nova acrylic paint and products. Nova employs a tough, durable, 100% acrylic resin suitable for use outdoors. The murals will also be treated with a clear top coat to protect against dampness, fading due to UV rays or weather damage. No fluorescent paints are proposed for any of the murals. b. Durability and permanence, including ability to withstand age, vandalism and weathering. Consideration should be given to anti -graffiti coating: The murals will be painted on building walls that have been leased for ten years. All three murals will be painted using Nova acrylic paint and products. Nova employs a tough, durable, 100% acrylic resin suitable for use outdoors. The murals will also be treated with a clear top coat to protect against dampness, fading due to LTV rays or weather damage. Each spring, the murals will be examined by technical consultants retained by the Edmonds Mural Society for signs of fading due to ultra -violet rays or dampness or weather damage. Any damage will be immediately repaired in consultation with the technical consultant and artists hired by the Edmonds Mural Society. Any graffiti on the murals will be painted over. c. Compatibility of the artwork with architectural elements, other elements of the street, and adjacent structures. Compatibility shall be determined by relationships of the elements of form, proportion, scale, color, materials, surface treatment, and size and style of lettering. Lettering shall be minimized, but may be considered for inclusion when necessary to the artistic content. All three.murals are compatible with the character of the buildings on which they are being placed as well as the downtown Edmonds streetscape. Only the mural at 504 — 5`h Avenue South contains letter, which is "It's an Edmonds Kind of Day" reflect the theme of this year's murals. He submitted a catalog which offered a variety of light fixtures. Board member Birch said he recalls that the Board had originally selected the one -globe light fixture. Mr. Finke noted that the Parks & Recreation Department had submitted different varieties of a one -globe fixture but excluded the multi -globe fixtures. Board member Beck inquired if the three -globe fixtures on street corners and one - globe fixtures in between corners has been considered. Mr. Mayo said he attended the D-DAT meeting, and a three -globe fixture was recommended. Board member Beck recommended that a comprehensive street light plan be introduced. Mr. Bowman remarked that although freestanding signs are discouraged in the BN zone, this particular site needed one. The building lies perpendicular to Edmonds Way, with only one tenant having direct exposure to Edmonds Way and the remaining four tenants fronting onto an interior parking lot. The required landscaped area under a freestanding sign was not indicated, and Mr. Bowman said that would be needed. He said he would like to see a uniform sign package for the entire building. ADB-135-79 LAURENCE and CAROLYN HARRIS - Review of final site and landscaping plans for professional office at 601 Main St. (RMH) Mr. Bowman said the landscaping appeared adequate, but the triangular planting beJs should be expanded to a rectangular shape to reduce the paved area. Elevations and materials were not indicated for fences or retaining walls. Marshall Menne represented the applicants and he said the fence would be of 1"x 1" cedar strips and the retaining wall along 6th Ave. would be of concrete with washed face. The house would be beige with brown trim and stain on the screening to match the trim. Assistant City Engineer Pat Wilson amended comments made at the previous hearing to accept two parking stalls with the provision that business use of the building exclude medical/dental clinic use. He said parking stalls should be dimensioned on the plan as 9'x 20' with 2' clear from the alley line to accommodate screening. He recommended a 3' maximum height of screening at the north and south sides of the 24' parking entrance/exit. The plan had shown 4', but 3' was acceptable to Mr. Menne. MR. ADB-26-80 PHYLLIS MASTERJOHN - Review of sign for day care center at 700 Main t. U Mr. Bowman stated that this is one of the largest tenants at the Anderson Center. There was no existing sign and the proposed sign conformed to the Sign Code. The Parks and Recreation Division had no objection to the location or size of the sign, but they felt the sign should be constructed of routed wood with natural color stain so it would conform with other signs at the Center. However, it was noted that freestanding signs are discouraged in the BN zone. The applicant would construct a planter box between the columns of the sign. The proposal was discussed, and MR.
