CODE APPLICATION.• Chapter 18.70, 17.65, and 17.70.040 of the Edmonds Community Development Code. All terms
of the adopted ordinance are incorporated herein as if set forth in full and this permit therefore is subject to the terms of
those chapters.
FOR THE TERM IN WHICH THIS PUBLIC USE/ENCROACHMENT IS INEFFECT, THE OWNER SHALL COMPLY WITH
THE PERMIT CONDITIONS SET FORTH BY THIS PERMIT.
NOTE: The issuance of this permit is understood by the owner to be of a temporary nature, shall vest no permanent right
and shall be issued and may in any case be revoked at the sole discretion of the City per ECDC 18.70.040. Applicant is
responsible to provide a copy of the insurance certificate to the City at the beginning of each calendar year, no later
than the 21st day of January.
INDEMNITY: The Applicant understands and agrees to hold the City of Edmonds harmle s from any injuries, damages
or claims of any kind or description whatsoever, foreseen or unforeseen, that may be made against the applicant or the
City of Edmonds, or any of its departments or employees, including but not limited to the defense of any legal
proceedings including defense costs, court cost, and attorney fees by reason of granting this permit. In addition, the
applicant understands that he/she shall provide and conflilually maintain during the term of the permit a certtfficate of
insurance naming the city as an additional insured with respect to liability, and providing that it shall be primary as to
any other policy of insurance.

CONDITIONS
The proposal 'will not adverselyimpact public space open to vehicular or pedestrian travel.
• Architectural Design Board Approval has been granted or the process has been administratively
approved.
• The proposal will not unreasonably interfere with the rights of the public.
• Items shall be placed adjacent to the building and may encroach onto a maximum of two feet of the
public sidewalk; or in accordance with Bistro and outdoor dining code; or per an approved building
permit.
• Safe Pedestrian travel area, or clear zone, of 44 inches minimum width, providing a level safe walking
surface along the public sidewalk, shall be maintained. (e.g. measuring 44 inches from edge of street tree
grates or newspaper stands toward place of business.)
• Exterior light Fixtures, banners, signs and flags must provide for a minimum clear zone of 7 feet above
City right-of-way.
• Clear Landings of 44 inches or no less than the width of the door (whichever is greater), measured
toward the street, shall be maintained on the exterior side of all required exit doors.
• Illumination from the city light fixtures shall not be blocked.
• No objects shall be hung from the City light standards.
• Three feet of clearance around fire hydrants, standpipes, P.I.V.'s, manholes, water meters, blowoffs,
cleanouts and valves shall be maintained.
• Applicant shall repair/replace all damage to utilities or frontage improvements in City right-of-way per
City standards that is caused by or occurs during the permitted project.
• Sound/Noise originating from temporary construction sites as a result of construction activity are exempt
from the noise limits of ECC Chapter 5.30 only during the hours of 7:OOam to 6:OOpm on weekdays and
10:OOam and 6:OOpm on Saturdays, excluding Sundays and Federal Holidays. At all other times the
noise originating from construction sites/activities must comply with the noise limits` of Chapter 5.30,
unless a variance has been granted pursuant to ECC 5.30.120.
• Applicant, on behalf of his or her spouse, heirs, assigns, and successors in interests, agrees to indemnify
defend and hold harmless the City of Edmonds, Washington, its officials, employees, and agents from
any and all claims for damages of whatever nature, arising directly or indirectly from the issuance fo this
permit. Issuance of this permit shall not be deemed to modify, waive or reduce any requirements of any
City ordinance not limit in any way the City's ability to enforce any ordinance provision.

has informed this office that the kitchen in the above
establishment is.not equipped with a grease interceptor, as
required by the Uniform Plumbing Code and City policy.
Lack of an interceptor on kitchen waste lines is imposing
maintenance problems on the sanitary sewer serving the
building.

in topography the proposed tennis court will be much lower than the adjoining
residences. Mr. Wallis showed slides of the site. He said the developer had
taken advantage of the PRD ordinance and had done a very creditable job, having
worked closely with the staff. He recommended approval. Discussion was opened
to the public.
The applicant said he had worked ►•pith,the Engineering Department on the drainage
and had received preliminary approval from that department. He explained the
drainage system. Mr. Larson said they still had to go over the details of the
-storm drainage. Mr. Pantley distributed copies of the homeowners' association
agreement. He stressed that he thought design was important and he had tried to
avoid the "bowling alley" cul-de-sac concept. He noted that berms at the entrance
to the cul-de-sac will reduce road noise within the site and reduce site distance
from cars passing the site. He said all of the homes will face onto a courtyard
and it will be a cohesive, small neighborhood. The question of a sidewalk on
80th Ave. W. was raised. Mr. Pantley said he would be paying into a sidewalk
fund as established recently by the Council. This was discussed at length, with
the alternatives of the fund, a permanent walkway, and a crushed gravel walkway
all being discussed. Mr. Pantley said he was willing to do whichever was desired,
but he hoped it would tie into the rest of the street. Mr. Pantley also said he
would like permission to use a thickened asphalt rolled curb around the cul-de-sac
instead of a concrete rolled curb. Mr. Larsen said if this were to be a public
road he was inclined to prefer concrete curbs because of maintenance costs to the
City and strength of the curbs. Mr. Pantley said he would be willing to bond for
four years, instead of two, if granted this change.- The public portion of the

COUNCILMAN GELLERT, TO APPROVE PRD-2-77, ALLO11ING THE REQUESTED THICKENED ASPHALT
ROLLED CURB AROUND THE CUL-DE-SAC AND ACCEPTING THE APPLICANT'S OFFER TO BOND FOR
FOUR YEARS INSTEAD OF TWO, AND REQUIRING AN APPROVED CRUSHED ROCK SIDEWALK, LOCA-
TION OF THE SIDEWALK TO BE DETERMINED BY THE ENGINEERING DEPARTMENT. MOTION CARRIED.
At this time Councilman Carns asked to interject on something he should have brought
up under the Council portion of the agenda. He noted that M.A.A. Herb Gilbo was
leaving the employment of the City and this would be his last Council meeting. He
said Mr. Gilbo had served the City for almost five years and had done an outstanding
job for -the City. He said he would like to see some kind of written commendation
given to Mr. Gilbo.

downtown area and he recommended allowing iton this building which is being remodeled.
He said street use permits are revocable so there is control. There was no comment
from the audience, and Mr. Wallis said this had been approved by the Amenities Design

REPORT ON PETITION RE TRAFFIC SITUATION AT OLYMPIC VIEW DR./PUGET WAY/196TH ST. (9:31p.m.)
Assistant City Engineer Dick Allen said a study had been made of the problem at this
intersection. The study revealed that several accidents had occurred during hours
of poor lighting. fie said there is a problem in the geometrics of the road so it
is difficult to see the pavement markings and there are'some blind spots coming
around the curve. He said the poor design had been reported to the State Highway
Department and will be considered in the improvements done there next year. In the
interim the Engineering Department was proposing to install two temporary street
lights in the area and to install reflectorized posts and replace the signs with
reflectorized signs. He felt this would temporarily solve the problem until the.
roadway can be redesigned. Police Chief Marlo Foster agreed that this portion of
• the roadway was very poorly designed. He was concerned that there is no provision
for pedestrians in this area and he was very concerned for the safety of children.
He felt there should be an overpass at Olympic View Drive for pedestrians.

ADB-54-76 WASHINGTON STATE DEPARTMENT OF FISHERIES / REID, MIDDLETON - Review of
Fishing Pier, foot of Dayton St.
Jim Reid of Reid, Middleton & Associates introduced Ray Buckley, project
manager of the fishing pier for the Department of Fisheries; Gordon
Maxwell, Port Commissioner; Bill Bayne., project engineer for Reid,
Middleton; and Larry Bailey, architect. Mr. Bayne described the
facilities to be on the pier, noting that there wi-11 be three service
units fo'r cleaning fish and there will be benches with windscreens on
the pier. Mr. Buckley said it is expected that there will be excellent
fishing from the pier, especially at night. Capt. Floyd Smi.th of 814
Dayton St. said he was opposed to overhead lights shining out on the
water, speaking from his experience on the water. He recommended that
any lights for attracting fish should be under the pier and that any
lights on the pier shine downward only. Mr. Buckley responded that the
proposed lighting will not be at all obtrusive. Capt. Smith also sug-
gested that the entrance to the pier be tied into the proposed waterfront
walkway under consideration. Regarding maintenance, Mr. Buckley indicated
the City will maintain the pier and run the concessions. MR. WIGHT MOVED,

ADB-52-77 .RANDY ENBERG - Sign and new roof line at 8402-8420 Bowdoin Way (BN)
Mrs. Block said this proposal .was for uniform signing at the Five Corners
shopping complex on Bowdoin Way. The applicant proposed to remove all
existing signing and construct a new mansard roof across the complex
on which all the signage will be placed. Mr. Enberg elaborated, saying
the lettering will be identical on all the signs, there being eight units
and all but one having a sign. The sign will be of 24" plywood, with
21" of actually lit area. The lit area will be white, with black lettering
and light grey trim. The roof will be of split shake. Mr. Enberg said
the end of the building is 50' deep of block structure, and that will be
covered with rough fir siding to make it more attractive. He displayed
a photograph of another building which used that treatment. Mrs. Block
said all the signs will be uniform and should conform to the sign area
allowed. MR. SELVIDGE MOVED, SECONDED BY MR. LaFON, THAT ADB-52-77 BE
APPROVED, WITH THE BLACK, WHITE, AND GREY COLORS FOR THE SIGN, AS
PROPOSED BY THE APPLICANT. MOTION CARRIED. Mr. Selvidge commented that
he had included the colors in the motion because they had been specified
by the applicant who wished to keep all the signs uniform in the complex.

Mr. Starr presented a drawing of the proposed sign. He said the sign
had been requested by the owner to be the same'as the existing sign on
. the back of the building. There will also be a Union Oil sign with
a single face, showing toward the water. Mrs. Block said the allowed
signage is 150 sq. ft. and the proposed signs will total 147 sq. ft.
