I am in receipt of a document tendered in place of a bond by Paul
and Linda Elliott. As you appear to be aware from the format of
the document, the City of Edmonds requires a bond, letter of
credit or similar security. In order to accept the agreement
which has been tendered, two changes will need to be made.
Please consider these changes. If they can be made, please
advise me, if not, the Elliotts need to provide a bond in a form
previously provided.
The first change is to Paragraph 1 which needs to be revised to
read as follows:
As required pursuant to ordinance number 2661
of the City of Edmonds, this document will
certify that this institution has established
an account with the proceeds of a loan for the
above referenced. project. This account is
irrevocably committed until released by the
City of Edmonds or directed for use as
provided herein for restoration and/or other
repair or stabilization measures as required
in accordance with Edmonds Community
Development Code section 19.05. By the
signature of its duly authorized officer of
this letter, this institution hereby agrees to
freeze the following sums of money for repairs
undertaken to stabilize the site, public
improvements, utilities and/or adjacent
structures, pending written authorization for
release of said funds by the City of

The second change would be the addition of the following language
as an additional paragraph:
By the signature of its duly authorized
officer below, Seafirst National Bank promises
to hold harmless and indemnify the City of
Edmonds, its officers, agents and employees
from any and all loss, claim or liability
arising from or out of its breach of this
agreement, including but not limited to loss,
claim or liability occasioned due to release
of these funds prior to written authorization
by the City or failure to freeze or maintain
said funds. The promises contained herein by
Seafirst National Bank shall be independent of
any underlying loan agreement between the
owners, Paul M. Elliott and Linda Elliott, and
Seafirst National Bank.

RE: Homeowner Insurance Coverage for Meadowdale Development

As you may recall, development of your home was subject to Edmonds Community
Development Code (ECDC) Chapter 19.05.050 which regulated construction and
insurance coverage requirements for all designated Meadowdale Landslide Hazard Area
development. The purpose of this letter is to inform you that the Edmonds City Council
has enacted a change which effects your homeowners policy that was required by this
ordinance. If you recall you were required to post a one million dollar homeowner policy
in order for your home to be granted final occupancy. Please be advised, the City
Council has repealed this requirement effective April 16, 1999. In lieu of this policy the
City Council will be holding future public hearings to determine alternate coverage
methods to ensure that the intent of ECDC 19.05.050 are still met. Please contact the
City Clerk if you are interested in attending these meetings.
You may wish to consult your insurance professional to determine the proper amount of
insurance coverage necessary to meet your specific needs. Since the insurance
requirement is repealed the City no longer requires to be informed of your coverage or be
provided with a copy of your current policy.
