HALL MAYOR Re: MEADOWDALE ORDINANCE PUBLIC LIABILITY INSURANCE REQUIREMENTS Lot 10, Plat of Lorian Woods Dear Mr. and Mrs. Derry: Your request for a waiver from the public liability insurance - requirements of Chapter 19.05.050 of the Edmonds Community Development Code and Ordinance #2866 was brought to my attention on March 4, 1993 by Jeannine Graf, Acting Building Official. After consultation with Scott Snyder, City Attorney, and site inspections by personnel from both the Engineering and Building Departments, as Community Services Director I have exercised the authority given me under Chapter 19.05 and have determined that it would be appropriate for the City to grant your request for a waiver. Decisions such as this are based on site specific conditions and made only after review of the potential loss to both public utilities and private property which could be attributable to your development. In the case of your development it was determined that in the event of a landslide, or similar earth movement, damage would be negligible. It was fortunate that, due to the conditions of your specific site, the City was able.to arrive at a decision that has enabled you to proceed with obtaining final approval on your project. The ordinance for this requirement was passed after oux permit application was submitted. Never -the --less, we have attempted to obtain this coverage from three different. .insurance firms. All have refused and have stated that this type of coverage is not available on home -owners or on personal liability policies. (Apparently it is available Can commercial policies but we have no way of obtaining a commercial policy.)
