Due to medical issues, and Covid related issues the applicant is not able to meet the expiration date of
their application. They have already received the 4 month COVID19 extension. Planning is working on a
LLA that needs to be completed before or with this work.
Is it possible to extend this permit application another 90 days?

Good afternoon Denise:
Yes, I did have a zoom meeting with Michele, Kiernan Lien and Deb Powers on November 10, which was
suggested by Michele after I called her and left a detailed voicemail message to discuss her written reply
to my letter dated October 4, 2021. 1 was planning to give you an update today, so your email is quite
timely. In response to your direct inquiry about re -submittal, the plan is to do so as soon as possible.
However, it is not possible to do so on or before November 16, 2021. 1 don't know if you got an update
from City staff, but during the meeting, I advised the group that my involvement up to his point has
been from the 30,000 foot level but it will be much more hands on from here on out. As you know the
compliance issues are outstanding due in part to covid and in large part to the applicants' daughter's
serious health issues that have put her in and out of the hospital for most of her young life and now
requires in patient care in Salt Lake City to the extent that the applicants will be selling their Edmonds
home and relocating around the end of 2021. The applicants recognize the code issues need to be
disclosed on Form 17 and intend to complete as much as possible as quickly as possible,
notwithstanding the work stoppage during the winter on critical slopes due the weather. As a result, the
applicants may be limited to securing contracts for the work to be completed in the spring.
The applicants have requested me to do what I can to re -submit the building permit to you and I am
working on it. I have emailed the Notice of Critical Area to the applicants for notarization. The applicants
are currently in Salt Lake City and we have some pending discussions that need to be addressed. Please
be advised the applicants intend to forego the stairs, handrails and all issues that may complicate this
project. The goal is complete compliance and cooperation to the fullest extent possible. The applicants
do plan to remove the retaining walls within the buffer and re -plant as suggested by the critical area
consultant. Removal of the 3 walls will be monitored by Nelson Geo-Tech. We plan to address all
comments submitted by staff. While attorneys are supposed to know everything, I will be the first to
say, I am not a permit expert but I will do the best I can with the information available. During the
November 10 meeting, I advised Michele and the group of the foregoing and the November 16 deadline.
Under the circumstances, the group did not believe an extension would be a problem. The goal is getting
the job done and that is exactly what the applicants intend to do with my assistance. I trust the
