Attached please find AT&T's written declaration in response to Condition #1 and a summary of the steps we are taking to comply with Conditions 2, 3 and 4. AT&T's Response to Conditions of Approval As stated in AT&T's attached written declaration, the approved AT&T small wireless facility does not utilize a "unified enclosure" as described in ECDC 20.50.130.D.4.b. Regardless, AT&T is unable to reduce the size of the proposed equipment enclosure to less than —4.442 cubic feet, as it is the minimum size necessary to contain the "pico" configuration equipment. 2. SnoPUD has confirmed that it will remove the one (1) existing conduit and meters on the pole, shown below. With the removal of the existing conduit, the total number of conduit is reduced from four (4) to three (3), which complies with ECDC 20.50.130.D.4.d. 3. We have confirmed that SnoPUD is able to allow a smaller than 18-inch standoff bracket. The final bracket size will be the minimum size necessary to accommodate the conduit and required PUD buffer. SnoPUD has confirmed that it is able to order from the EWEB equipment catalog, and the bracket model # will be confirmed as part of the final pole design. A sample EWEB bracket selection is attached. 4. The replacement pole location will be finalized in SnoPUD's forthcoming permit application. The replacement pole shall be located to comply with the applicable laws referenced in ECDC 20.50.130.C.4: "Replacement poles, new poles, and all equipment shall comply with the Americans with Disabilities Act ("ADA"), city construction and sidewalk clearance standards, and state and federal regulations in order to provide a clear and safe passage within the rights -of - way." The City has completed review of the application based on the information we have and no longer requires supplemental information from the applicant. We've determined that the criteria to move beyond Location Preference 2 has been satisfied and we're continuing to analyze the application. It appears as though we will be able to issue the right-of-way permit application soon. As the City received the right-of-way permit application last year, can you please confirm that the contractor information remains correct. The condition of approval states: 1. Reduce the size of the equipment enclosure from 4.442 cubic feet to a maximum size of 4.0 cubic feet and mount it no more than 6 inches from the pole to comply with ECDC 20.50.130.D.4.b: "To the extent technically feasible, antennas and equipment located within a unified enclosure shall not exceed four cubic feet ... The unified enclosure may not be placed more than six inches from the surface of the pole, unless a further distance is technically required and confirmed in writing by the pole owner." The size of AT&T's proposed unified enclosure depicted on sheet A-6 is 4.442 cubic feet. If a maximum size of 4.0 cubic feet is not technically feasible, please so indicate in a declaration. ECDC 20.50.130.D.4.b is not applicable to this small wireless facility ("SWF") design. A "unified enclosure" is typically defined in other jurisdictions as "a small wireless facility providing concealment of antennas and equipment within a single enclosure." 1 The ECDC does not define a "unified enclosure", but does contain a photographic example under ECDC 20.S0.130.D.1.i: The design of the SWF in this permit is not a "unified enclosure" described in ECDC 20.S0.130.D.4.b because the antenna and equipment are not located within a single enclosure. Instead, the approved design shows the antenna mounted —13 feet higher than the equipment enclosure. Currently, the smallest equipment enclosure AT&T is able to deploy in our SWFs is —4.442 cubic feet, as shown on the attached spec sheet from Commscope. This —4.442 cubic feet "pico" equipment enclosure is the minimum size necessary to contain the "pico" configuration of AT&T SWF equipment and is the same model number shown on Sheet A-6, Detail 1 of Attachment 4 to the approved permit. Finally, the condition of approval also requests that the enclosure be mounted no more than 6 inches from the pole. This is addressed in separately in AT&T's response to Condition of Approval #3, which is not repeated here to avoid duplication. Thank you for your consideration.
