The fence was built in the city right-of-way without a permit and the homeowner was notified on 5/21/2021 by code enforcement that he would need to get a permit. After the permit was applied for it was discovered that the fence was in the right-of-way and would require an encroachment permit to be recorded against the property. Exhibit B is part of the encroachment permit. This is a drawing of where the fence is located in relation to the subject property. I have attached Mr. Mannix Exhibit B for reference. In the attached Exhibit B the fence is clearly in front of the subject property when in fact the actual fence extends beyond the property line to the south into the access easement. The easement that is to the south is on the neighbors property and the fence shall not extend beyond the property lines. Even though this access easement is for your property it is still owned by the neighbor to the south. Mr. Mannix has an issued building permit for the fence. The permit is to build the fence, once the fence is built it will require a final inspection. The permit does not have final approval from the city and in fact has a correction on the final inspection. The correction is for the fence being built too close to the city sewer main. The city sewer crew confirmed that the fence is only 21 inches from the sewer main and that is entirely too close. The permit is not approved until the final inspection is approved. Please comply with the issued correction notice. Please remember this fence is was built without a permit on city property, and shall comply with all city requirements. Gabriel and Lauren Mannix have an approved building permit, No. BLD2021-0737. They also have an approved encroachment permit, No. ENP2021-0051. I own an adjacent lot with an address of 21222 Pioneer Way. This adjacent lot has an access easement which crosses the property at 21220 Pioneer Way. This access easement runs parallel to the fence which was installed by Gabriel and Lauren Mannix. As the owner of the access easement, I need to advise you that I have no objection to the fence which was installed by Gabriel and Lauren Mannix. By the way, if you are looking at ownership information on my property, it is under Oregon Excellence, LLC. I am the owner of Oregon Excellence, LLC. It is my understanding that Gabriel and Lauren Mannix installed the present fence at the edge of their property in replacement of another fence which already existed at that location for at least 13 years. It is also my understanding that no issue has been raised over these many years as to the effect of this permitted fence as to any city water or sewage lines. You apparently have received a complaint that this fence is within five feet of a sewer line and needs to be moved. As I am the owner of the access easement which adjoins this fence line, and as I am the father of Gabriel Mannix, I would very much like to clear up this situation. If you need to have me appear in an official capacity rather than as a father/neighbor, I am an attorney admitted to practice law in Oregon, but I own my law firm and one of my associates is Nicole Weston, who is admitted to practice law in the state of Washington. For the moment, I prefer to proceed as an interested neighbor and as a father. I have attached all of the documents provided to me by Gabriel Mannix in regard to this matter in case these help to clarify things. It seems to me that we have a situation where no problem has arisen for many years in regard to the sewer line and in regard to the fence, other than the fact that you have received a complaint from someone. Since there is no underlying evidence of a problem, I do not see why the city would require Gabriel Mannix to document the location of the city sewer line. I ask that you defer any further action in this matter until I have an opportunity to confer directly with one or more of your officials in regard to this matter. I live in Salem, Oregon, and my law firm is located in Salem Oregon, so I would prefer a telephone conference or a Zoom meeting. Alternatively, an email exchange may suffice.
