Woodinville, WA 98072 One Douglas fir and two Western hemlocks are proposed to be removed from the Woodridge Apartment site. C. Findings and Conclusions 1. The Woodridge Apartment complex at 20904 — 21010 83rd Ave. W consists of 48 dwelling units in four buildings. Project design and landscaping was approved through permit PLN1978-00051 and the project was constructed in 1980. The site is zoned Multiple Residential (RM-2.4) and is surrounded by residentially -zoned and developed parcels. The apartment site is currently heavily trees and well landscaped. 2. Landscaping changes and tree removals at multifamily -zoned sites are processed as a Type I permit (staff design review of a landscape modification). The landscaping and tree standards in Chapters 20.13 and 23.10 of the Edmonds Community Development Code (ECDC) apply to this proposal. Pertinent definitions include: "Significant tree" means a tree that is at least six inches in diameter at breast height (DBH) as measured at four and one-half feet from the ground. For trees with multiple leaders at four and one-half feet height, the DBH shall be the combined cumulative total of branches greater than six inches diameter at four and one-half feet above the average grade. If a tree has been removed and only the stump remains that is below four and one-half feet tall, the size of the tree shall be the diameter of the top of the stump. [ECDC 23.10.030.R] b. "Hazard tree" means a tree that is dead, dying, diseased, damaged, or structurally defective as determined by a qualified tree professional. [ECDC 23.10.030.H] 4. According to the tree inventory and report prepared by certified arborist Ralph Dobson, 81 significant trees were inspected and three are proposed for removal: #38 (fir), 50 and 51 (hemlocks). The City's Urban Forest Planner reviewed the proposed removals and confirmed the these three trees meet the definition of 'hazard tree'. 5. Four other trees were noted in the tree inventory as being in poor health and recommended to be removed: #23, 37, 41, and 44. While not specifically proposed to be removed by the applicant, the Urban Forest Planner field -verified that those four trees do meet the definition of 'hazard tree' and therefore may also be removed as part of this permit. 6. According to the tree code, replacement is not required for the removal of hazard trees (ECDC 23.10.080.13). However, tree replacement is typically required for multifamily -zoned sites that apply for landscape modification per ECDC 20.13. In this case, however, the site is heavily treed and none of the three proposed tree removals (nor the four other trees that may be removed) are located on the edges of the site where replacement buffer landscaping would be appropriate. As a result, no replacement landscaping is required for this permit. D. Decision Based on the findings, conclusions and attachments to this report, the landscape modification design review in file PLN2022-0033 is approved with the following conditions: 1. This permit is valid for the removal trees #39, 50 and 51 as well as the four additional hazardous trees noted in the tree inventory that have been confirmed to be hazardous (#23, 37, 41, 44). 2. Replanting is not required for the removals in Condition #1. 3. Trees shall be fell onto private property. Should it be necessary to use any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of- way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 5. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 6. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 7. Contractor/owner is responsible for locating all on -site utilities and any utilities on neighboring properties that could be impacted by the tree removal. Relocation/revision/repair to any utilities may require separate permit. E. Attachments 1. Land use application 2. Cover letter 3. Arborist report 4. Tree inventory 5. Replanting plan 6. Staff technical comments F. Expiration Per ECDC 20.11.050.A, this design review decision is valid for 18 months. All approved work must be completed within that period or the decision expires unless an extension is requested per ECDC 20.11.050.13. G. Appeals Staff design review is a Type I decision which pursuant to ECDC 20.01.003.13 is subject to judicial appeal. Type I decisions may be appealed by a party of record with standing to file a land use petition in Snohomish County superior court. Such petition must be filed within 21 days after issuance of the decision, as provided in Chapter 36.70C RCW. Your request to remove 3 trees based on hazard tree criteria is approved for Trees: #38, 50 and 51. On -site observations confirm that 4 additional trees noted in the inventory as dead, dying, or poor condition (#23, 37, 41, 44) also fit hazard criteria and may be removed as well. Per ECDC 23.10.080.13, tree replacements are not required if the removed trees are hazardous, dead, diseased, injured, or in a declining condition with no reasonable assurance of regaining vigor. Since the 7 trees listed above fit those criteria and the site is heavily wooded, planting the 3 proposed Western Red Cedar replacement trees shown on the Replanting Plan is at the applicant's discretion.
