INSPECTION REPORTS BUILDING JAN 6 - 1997 PROJECT NO. 33096 Inspected reinforcing steel in the following locations, and found it to conform to approved plans and specifications: Curved strip footing supporting retaining wall for driveway, east of 20 line from C to F. Three small strip footings supporting walls for portico, west of 3 line. Contractor placed 19 cubic yards of Lonestar mix 93400 in these locations via truck pump and wheelbarrow, consolidating it with a mechanical vibrator. This mix was as specified on S1 of the approved drawings. Sample taken had a slump of 3" and a temperature of 550 F. Three cylinders were cast for lab curing and analysis. All items inspected are in accordance with approved plans and specifications. INSPECTOR: Trip Edgerton 12-26-96 Contractor began stressing eastern pour of second level post -tension deck. Contractor attempted to stress all 39 distributing tendons in this pour. 36 tendons were stressed to within tolerance. Two tendons had anchor wedges that failed at the time of stressing. -One- tendons' anchor wedged failed subsequent to stressing. Contractor elected to stop the stressing operation due to inclement weather and to evaluate the failed anchor wedges. Some punchlist items remain to be resolved before final approval in a.m. INSPECTOR: Trip Edgerton 12-20-96 Performed final inspection of conventional reinforcing and post -tensioning material in level 2 post -tension deck, and found it to conform to approved plans and specifications. Contractor placed approximately 234 cubic yards of Lonestar Mix #3420 in this location and in a previously inspected slab on grade (stair #2 and mechanical room). Concrete was consolidated via mechanical vibrated and bull float. Two samples of three lab cures (6" x 12") and three field cures (4" x 8") were cast. (I believe my secretary conveyed that to you during your last phone call to my office.) The City's code does not allow for discretionary power in this matter. With regard to the subject project, Chapter 19.00.01 OD of the Edmonds Community Development Code states that permit applications shall expire within 180 days of application. The Building Official may extend the time for action for a period not exceeding 180 days but no application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit a new permit application, plans, and pay a new plan review fee. According to building division records, the original permit application was submitted on 1-26-94 and was due to expire 180 days later on 7-26-94. Since the permit was not ready to be issued on 7-26-94 the application was granted an extension of 180 days (as permitted by the code) which established the new expiration date of 1-26-95. The permit application was extended once as allowed by code and no further extension can therefore be granted. If the applicant is interested in pun suing this project a new permit application, must be submitted with plan review fees of $4,511.00. The City will keep the file information for 15 days with the intent that the applicant will submit a new application. The problem is that by ECDC Chapter 19.00.010D the permit application for SMK Development expired on 1/26/95. According to our files, the last official contact the City had with Mr. Westlin (prior to the expiration of this application) was literally the day he submitted for the permit on 1/26/94. We sent him the first plan review letter on 2/28/94 (with no response). The Engineering review was sent 2/14/94 (with no response). In fact not one City department has approved even one aspect of the plans for this project. On 2/7/95, the Permit Coordinator followed proper building division'procedures and informed the applicant in writing that the subject application expired on 1/26/95. I cannot more strongly express the importance for consistency and equal treatment among all applicants. To allow an applicant to deviate from the code requirements (even for a most valid reason) would place the Building Official in an awkward and most subjective position on future applications. How will,I determine valid reasons for other requests for application extensions? Is it only medical problems or do financial problems generate leniency? Once we break the rules are we obligated to research and refund past applicants? Where does this end? The answer is that it ends with the established code, ordinance or law that is the will of the people and which is summarily endorsed by City Council. These are the laws which we must all abide by and enforce. In conclusion, since the code does not provide discretionary power this matter should be closed. Graf, Building Official DATE: March 14, 1995 RE: SMK Development 55 Unit Motel At the request of your secretary I am responding to a letter dated 3/9/95 to the Mayor regarding the Kim 55 Unit Motel project (Donald Westlin, Architect). As you are aware, Chapter 19.00.010D of the Edmonds Community Development Code (copy attached) is extremely clear. Permit applications expire within 180 days of submittal and may only be extended once for a period not exceeding 180 days. The City administratively extended the subject application to 1/26/95, as the code allows, and no additional extensions may be granted. In order to renew action on this application, the applicant shall resubmit plans and pay a new plan review fee, in this case another $4,511.00. During my tenure with the City of Edmonds we have been consistent in applying this code section and there is no administrative recourse for the applicant. This is additionally supported by Section 304d of the Uniform Building Code which sets forth the same requirements. Note, this expiration time frame for permit applications is virtually statewide, since most jurisdictions have adopted the Uniform Building Code. I won't burden you with a duplication of dates, however, from the enclosed copies it seems apparent that Jeanine Graf will not honor my request for an extension of time. I had responded to the ICBO Plan Check #6946 in my letter of March 15, 1994, however, because my mechanical engineer had not completed his calculations and details, I was not able to return the letter and revised drawings to the Building Department. Subsequent to this I experienced some heart difficulty and ultimately into an angiogram exploration by my cardiologist. It took me some 6 months to get back to the office and in the meantime I lost my trusted employee and all contact with the 55 Unit Motel project. As you can see from the enclosed letter of February 21, 1995, I appealed to Sharon Nolan for an extension of time and was turned down by Jeanine Graf in her letter of February 24, 1995. Part of my community participation in the pa4 was serving for 5 years as Chairman of the Lynnwood Planning Commission as well as a member of the Architectural Design Board for the City of Edmonds from December 1973 to October 1977 as a favor to.then Mayor Harve Harrison.
