S-25-74 RECORDED UNDER RECORDING NO. 201903220376, WHICH IS AN AMENDMENT OF RECORDING NOS. 2357897 AND 2357898, BEING A PORTION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 27 NORTH, RANGE 4 EAST, W.M., RECORDS OF SNOHOMISH COUNTY, WASHINGTON; SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. Hoy/Oka owns the following described property adjacent to Henderson and has requested Henderson grant an easement for sewer line purposes: LOT 2, CITY OF EDMONDS SHORT PLAT NO. S-25-74 RECORDED UNDER RECORDING NO. 201903220376, WHICH IS AN AMENDMENT OF RECORDING NOS. 2357897 AND 2357898, BEING A PORTION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 27 NORTH, RANGE 4 EAST, W.M., RECORDS OF SNOHOMISH COUNTY, WASHINGTON; SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. AGREEMENT NOW, THEREFORE, in consideration of the mutual promises between the parties and other valuable consideration, the parties agree as follows: 1. Henderson hereby grants and conveys to the present (Hoy/Oka) and future owners of the Hoy/Oka property described above an easement for sanitary sewer line purposes under and across that portion of the Henderson property described as follows: THE NORTH 10.00 FEET OF THE EAST 33.00 FEET OF THE FOLLOWING DESCRIBED PROPERTY: LOT 1, CITY OF EDMONDS SHORT PLAT NO. S-25-74 RECORDED UNDER RECORDING NO.201903220376, WHICH IS AN AMENDMENT OF RECORDING NOS. 2357897 AND 2357898, BEING A PORTION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 27 NORTH, RANGE 4 EAST, W.M., RECORDS OF SNOHOMISH COUNTY, WASHINGTON; AS SHOWN ON EXHIBIT A HERETO. SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. 2. All work to be performed by Hoy/Oka on Henderson's property shall be performed in a careful and workmanlike manner, free of any claims or liens in the least invasive means necessary. Upon completion of construction of the portion of the sewer line on Henderson's property and any subsequent work performed by Hoy/Oka on Henderson's property, Hoy/Oka shall remove all debris and restore the surface of the property, including landscaping as nearly as possible to the condition which it was at the time of commencement of such work. 3. Hoy/Oka may maintain the sewer lines within said easement and shall have the right to access the easement area for said maintenance. 4. The easements, covenants, and restrictions herein shall inure to the benefit of and bind the successors of the respective parties and shall run with the land. Easement Agreement -2- 5. This easement shall be effective upon recording. 6. The prevailing party shall be awarded reasonable attorney fees and costs in any court or arbitration proceeding initiated to enforce any provision of this instrument.
