Condominium Rules and Regulations. No application will be reviewed unless it is complete.
A complete application must include, where appropriate, construction drawings, plans,
specifications, and all other information needed to permit the ACC to fully review the proposal
and its potential impact on the Gregory Condominium.
PARKING NOTES: The City of Edmonds requires parking permits for street parking beyond the
posted limits; curb signs are available to reserve parking spaces. The Gregory requests that
contractors NOT park directly in front of commercial businesses on Fifth Ave, if possible.
Alternatively, tools/materials can be unloaded from Fifth Ave before vehicles are moved.
Please read the instructions carefully in order to avoid unnecessary delay in processing.
NOTE:: NO WORK THAT REQUIRES ACC APPROVAL MAY BEGIN UNTIL THE ACC HAS GIVEN ITS

EXHIBIT 4 — Awning and Sunscreen Request Instructions
The following steps are necessary for those requesting permanent deck modifications by adding
an awning or sunscreen.
1. Request an Architectural Control Committee (ACC) form and Hold Harmless Agreement
from the Managing Agent.
2. Owner requests consultation with professional contractor approved by the Association
meets with the interested Owner regarding awning/sunscreen attachment to the
building.
3. Owner must follow the uniform design guidelines.

4. Owner submits entire ACC packet: ACC form, design guidelines documentation, and
Hold Harmless Agreement to the Managing Agent who presents to the Board.
S. Gregory Board votes on the ACC request.
If no,
Owner reconsiders and addresses the Board's concerns.

• Owner receives approval letter from the Board.
• Owner requesting awnings is required to submit letter to the City of
Edmonds for a permit.
• Owner or installer goes to the Edmonds City Planning Department for a
permit. PERMIT IS ONLY NEEDED FOR AN AWNING NOT THE SUNSCREEN.
• AWNING PERMIT REQUIREMENTS: 2 copies of awning installation and
motorized retractable; 2 copies of attachment details; 2 copies of
elevation view of awning; 2 copies of valuation of the job; and a letter of
approval from the board.
• Owner sends note to the Board that the permit is obtained from the City.
6. Owner pays for the approved licensed company to install the awning and sunscreen.
Owner agrees to have work completed during hours 8 am to S pm as provided by The
Gregory Rules and Regulations.
8. Owner agrees to put tarp down to protect the deck.

9. Owner agrees that all clean-up will be removed from building, not put in The Gregory
garbage.

COVENANT AND HOLD HARMLESS
[James and Suzanne Pettersson), (hereinafter referred to as the "Owners"), for
himself/hersel themse ves and his/her eilrs, executors, administrators, and assigns, jointly and severally
covenant with THE GREGORY OWNERS ASSOCIATION, a Washington nonprofit corporation, and its members,
successors, and assigns (hereinafterf —referred to as the "Association"), as follows:
This Covenant shall bind and burden the following real property, which is owned by Owners, is commonly
known as [Street address of the Unit] (hereinafter referred to as the "Unit'), and legally described as:
Unit [301] of The Gregory Condominium, according to Declaration originally recorded in
Snohomish County, Washington under Recording No. 200704040589, as thereafter amended of
record.
This Covenant shall benefit the real property commonly described as The Gregory Condominium
(hereinafter referred to as the "Condominium"), a condominium, according to the Declaration originally recorded
in Snohomish County, Washington under Recording No. 200704040589, as thereafter amended ("Declaration"),
and the Survey Map and Plans recorded in the official records of Snohomish County, Washington, under Recording
No.200704045162.
Owners shall have the right to perform certain work and make certain modifications to the Condominium
(hereinafter referred to as the "Work"), solely as described and limited on Exhibit A which is attached hereto and
incorporated herein by reference. Work that is not expressly permitted on Exhibit A is prohibited. Only the work
specifically authorized on Exhibit A may be performed.

Owners, at their sole expense, shall maintain and keep in good repair and renew from time to time all
components of the Work. Owners shall also pay .any increased maintenance and/or insurance costs incurred by or
chargeable to the Association by reason of the Work.
In performing the Work, Owners shall employ contractors who, prior to commencing work, shall waive in
writing all lien rights they may otherwise have against the Association, and who shall provide to the Association
satisfactory evidence that they are contractors currently licensed by the State of Washington, that they carry the
necessary bond and insurance required by the State of Washington, and that workers' compensation insurance
covers their workers. Notwithstanding the improvements by Owners allowed under this Covenant, any common
elements affected by the Work shall not be considered to be a part of the Unit or of the limited common elements
appurtenant thereto but shall be used and occupied solely by virtue of a license granted by the Board of Directors
of the ,Association. Owners shall be responsible! for any and all damages which may be done to the common
elements or any other part of the Condominium by the Owners or their Community Association Managers
(Community Association Managers is not wording, most say guests) and contractors in connection with, or which
otherwise result from, the Work.
If Owners fail to perform promptly and fully any obligations imposed by this Covenant, the Association
may perform such obligations and the entire amounts expended in performance thereof shall constitute a lien on
the Unit, payable by Owners, and collectible by the Association, in the same manner as an assessment pursuant to
Article 16 of the Declaration.
Nothing herein shall be construed as an alteration to or amendment of the common elements or limited
common elements described in the Declaration. This Covenant is intended only to set forth the rights and
responsibilities of the parties hereto in relation to this specific Work.
To the fullest extent permitted by law, Owners shall indemnify and hold harmless the Association from
and against all claims, damages, liability, losses and expenses (including but not limited to attorneys fees
expended by the Association to evaluate and/or defend against any claim and/or to prove its right to indemnity
under this Covenant), arising directly or indirectly out of or incident to the design, construction, existence, use,
maintenance or condition of the Work, regardless of whether or not such liability is caused in part by the
Association, its Community Association Managers or employees or an Association member. Such indemnity shall
include, but shall not be limited to, any insurance deductible for which the Association is responsible; any claims,
damages, liabilities, losses and/or expenses for which the Association's insurance does not provide defense or
indemnity coverage or for which coverage is excluded; and any claims, damages, liabilities, losses and/or expenses
in excess of available coverage under the Association's insurance. For purposes of this provision, the coverage
determination by the Association's insurance carrier shall be conclusive as to Owners and the Association shall
have no obligation to pursue legal action against any insurance carrier to obtain a more favorable coverage
determination.
The burden and benefit of this Covenant are intended to attach and become appurtenant to the real
property described in this Covenant and to be binding upon each party to this Covenant and their respective
successors, heirs, and assigns. This Covenant shall run with the land and shall be enforceable by the Association on
behalf of its members, or by any member(s) particularly aggrieved.
If either of the parties to this Covenant violate, infringe or omit to perform any of the covenants,
conditions or restrictions contained in this Covenant, and legal action is necessary to enforce this Covenant or any
of its terms, then the parry or parties taking such action and prevailing therein, including their heirs, successors,
administrators, executors or assigns, shall be entitled to their costs and actual and reasonable attorney's fees to
enforce tthis Covenant or its terms, whether such fees and costs are incurred before litigation, during litigation and
trial, or on appeal.
