Single Family Deck
On behalf of the Planning Division, I have reviewed the above building permit application. During
review of the subject submittal, it was found that the following information, corrections, or clarifications
need to be addressed. Please respond to the following items, so that review may continue:
1. Setbacks: A variance was granted in 1973 (V 28-73) which allowed for a minimum setback of 8
feet off Bell St. The property is a corner lot since there is frontage on both Bell St. and 9`s Ave. N.
and thus requires two (2) street setbacks and two (2) side setbacks. The property is zoned RS-6
and requires a street setback (west property boundary) of 20 feet, south setback of 8 feet per
variance decision, and side setbacks (north & east property boundaries) of 5 feet. Provide the
required 20-foot setback on the site plan for the western property boundary. The western most
portion of the deck if not more than 30 inches above ground level may project into the required
setback not more than 16 feet. It appears that the deck will he at grade along the western most
portion, and the remainder of the deck will be greater than 30" along the rear portion of the home,
please verify and show the required setbacks (16 feet for deck under 30" and 20 feet for deck
portion over 30") to the proposed deck. Note that any portions of the deck that do not meet the
required setbacks may not be expanded in any way within the required setback, and only like for
like replacement (including deck height) may be considered.
2. Geotech Report: A geotech report has been provided, however the Geotech report must
specifically address ECDC 23.80.060 and ECDC 23.80.070. Please have the Geotech address the
specific code sections.
3. Critical Area Report: A majority of the proposal includes development within the footprint of
existing development as defined in ECDC 23.40.005 and may be considered an allowed activity
pursuant to ECDC 23.40.220.C.3, however the proposal also includes an addition to the deck that
is outside of the footprint of existing development of 12 square feet. Pursuant to ECDC
23.50.040.I. Ld. additions to structures within critical areas and/or buffers with no more than 300
square feet of additional footprint requires a 3:1 ratio of native vegetative plantings. Please
provide a site plan showing the required native vegetative plantings of 36 square feet to address
the new footprint area of 12 square feet or revise the proposal to eliminate the additional
footprint.
4. Notice on Title: Pursuant to critical regulations (ECDC 23.40.270.B), sites with field -verified
presence of critical areas and/or critical area buffers for which a permit application is submitted
shall as a condition of permit issuance, record a notice of the existence of the critical area and/or
critical area buffer against the property with the Snohomish County Auditor's Office. Prior to
issuance of the building permit, the attached form must be recorded with the Snohomish County
Auditor's Office. Options for recording include;
a. Provide the City processing fee of $110 plus the County recording fee of $203.50 ($203.50
for first page and $1 for each additional page), for a total of $317.50, and the city will
record the notice for you; OR
b. Make your own arrangements to record at the County for the County's recording fee of
$203.50 for. one page plus $1 for each additional page and return a copy of the recorded
notice to the Edmonds Planning Division with the Auditor's recording sticker on the copy.
NOTICE OF PRESENCE OF CRITICAL AREA(S) AND/OR
CRITICAL AREA BUFFER(S) ON PROPERTY
NOTICE IS HEREBY GIVEN this day of " + , 2022, by Tim
E. and Teresa J. Healy ("Grantor"), as required by Grantee, City of Edmonds, pursuant to
Edmonds Community Development Code (ECDC) 23.40.270.13, that at least one type of critical
area and/or critical areas buffer has been found through field verification to be present on the
Property described in Exhibit A hereto. This notice is being recorded as a condition of issuance
for a development permit related to the property. As part of the permit application review process
it was determined that the following type(s) of critical area and/or critical area buffer(s) were
found to be present on the property: ;
• A Wetland and Stream are located across the northeastern portion of the property
which are considered critical areas pursuant to Chapter 2350 ECDC;ano.Chapter
23.90 ECDC `
• Slopes on and adjacent to the subject property exceed 40%.,.The steepness. of these
slopes classifies the site as a potential landslide hazard area' pursuant to Chapter 23.80
ECDC.
The City of Edmonds has adopted ordinances that regulate this type of critical area and/or
buffer. Prospective purchasers are advised hereby that these regulations may limit the type and/or
location of development or other use that may occur on the property. Please contact the City of
Edmonds for specific information about the applicable critical area regulations.
This notice shall remain on the title records of Snohomish County until released by the
City of Edmonds, which shall only occur if the owner is able to submit a critical areas report to
demonstrate to the City of Edmonds that the critical area designation no longer applies to the
Property. Any release of this notice shall be subject to applicable procedural provisions of the
ECDC.
