Mr. Rogojan,
We have received the latest submittal of your permit application for BLD2019-1496 and had to seek some additional
legal input due the project potential for discharge toward adjacent properties. We have decided we can approve the
project but need to take a few extra steps first.
1. You and your partner must complete the attached hold harmless agreement and record it on your title. Please
note that the document requires notary for your signatures and the addition of a legal description as exhibit A.
We will required a copy of the recorded document prior to issuance of the permit.
2. Upon receiving confirmation that you still wish to proceed, the second attached notice to downstream property
owners, along with a small copy of the plans, will be sent to both downhill properties at 21709 96th Ave W and
9502 217th St SW. We will allow at least 1-week (7-calander days) from the date on the letters before issuance
the permit.
Please respond to this email to let me know to proceed with sending the downstream notices. The only approvable
alternative that would not require these extra steps would be to secure an easement or other form of written approval
from the downstream neighbor(s) who might be impacted.
Please let me know if you have any questions. The review is on hold until we resolve this issue.
