That letter is enclosed. It has been more than 90 days since you were notified (January 24, 2022 was Day 90), but records indicate that you have not submitted the information requested by the City. Conclusions of Law Edmonds Community Development Code ("ECDC") 20.02.003(D)(2) provides that "[w]henever the applicant receives a notice that the contents of the application [ J is insufficient, ambiguous, undecipherable, or otherwise unresponsive of the information being sought, the applicant shall have 90 days to submit the necessary information." As noted above, you were notified by the City that additional information was necessary on October 26, 2021, and as noted in the referenced code, you were provided 90 days to submit that before this Type I Action was instigated. ECDC 20.02.003(D)(3) further provides that "(iJf the applicant does not submit the additional information requested within the 90-day period for the development project permit, the director shall make findings and issue a decision, according to the Type I procedure, that the application has lapsed for lack of information necessary to complete the review." As noted above, there is no evidence that you have submitted the additional information as requested. It is within the City of Edmonds Development Services Director's authority to instigate this Type I Action and to issue the decision below. Page 1 of 2 Decision Because you have not submitted the additional information requested within 90 days, pursuant to the above referenced codes, the City is hereby issuing this Notice of Type I Action and Decision ("Notice") that your application has lapsed for lack of information necessary to complete the review. No further action by the City will be taken on your application. If you believe you submitted the additional information requested and have supporting evidence, please contact the City immediately. According to ECDC 20.02.003.D.4, when an application has lapsed, you may request a refund of some or all of the preliminary application fee. To do this, submit a letter to the Development Services Director explaining the circumstances involved in the delay. Finally, pursuant to RCW 36.70B.130, property owners that are affected by the decision issued in this Notice may request a change in valuation for property tax purposes notwithstanding any program of revaluation. Any such request, if applicable, should be directed to Snohomish County. While the application was determined to be complete on October 5, the following corrections must be addressed before review of the project can continue. Please respond to each of the comments in a cover letter and by providing updated plan sheets or other materials, as necessary. 1. Number of PM trips. This number is needed for tracking as part of the subarea approval for the Highway 99 area. The traffic impact worksheet and SEPA checklist did not include this information. Please complete page 1 of the attached form. 2. Existing fence. Call out the existing fence on Sheet P1 and add that to the Legend. 3. Alternative Walkable Design Area. To use the 'Alternative Walkable Design Area' option for site design in ECDC 16.60.030.C.2, you need to justify how the site has "... unique and significant constraints related to pedestrian access and for which a phased design plan to increase pedestrian access and connectivity has been submitted to the development services department." If compliance with this option cannot be achieved, a new application to use the Exceptions Process for Pedestrian or Walkable Design available to auto sales uses in ECDC 16.60.030.C.3 would be required. 4. Type V parking lot landscaping. No landscaping is shown for the required off-street spaces. Update Sheet L1 to provide parking lot landscaping consistent with ECDC 20.13.030.E. 5. 'Storage'. The 'storage' element west of the proposed building encroaches into the required 5' auto -use setback from the street property line along 841h Ave. W. Remove the feature or revise its location to meet setbacks. 6. Amenity space. Describe how the amenity space next to Highway 99 meets the area and design requirements in ECDC 16.60.030.C.4. Revise as necessary. 7. Lighting. No site lighting was proposed. Verify that none is anticipated or design it in accordance with ECDC 16.60.030.C.5. 8. Building design standards. Redesign the proposed building to meet the design and massing standards in ECDC 16.60.060.D.2(c — e). A complete response to this information request must be received within 90 days or the application will lapse for lack of information (ECDC 20.02.003.11)). Make all resubmittals for this permit to me via email since this was not a MyBuildingPermit.com application. Additional information is requested from the applicant at this time. Please ask the applicant to respond to the following. Comments 1 —May 12, 2021 Comments 2 — October 26, 2021 October 26, 2021 — comment partially addressed. a. A storm drainage memo was provided; however, the City's Stormwater Engineer, Zack Richardson, indicated the memo does not make effort to resolve drainage mitigation requirements and is generally lacking. However, Zack has also stated the proposed improvements on site are limited in size compared to the remaining site area available for instillation of stormwater BMPs and he believes the project will have no problem meeting the requirements of ECDC 18.30 without major revisions to the site plan. Accordingly, he takes no objection to the project as proposed, pending more detailed review with building permit submittal. b. The existing stormwater detention system is shown, but not labeled completely. Please label both pipe sections and note each as existing. c. The existing stormwater system for the site includes a drainage swale along the north and west property lines. Please revise landscape plan to show the existing swale so any conflicts with proposed landscaping can be identified. 5/12/2021 comment - A preliminary storm drainage report and plan shall be submitted to the City to confirm project feasibility. Stormwater management shall be provided consistent with Edmonds Community Development Code Chapter 18.30 and the 2014 DOE Stormwater Manual. Refer to Stormwater Addendum, Appendices and Checklists for additional information. The plans and report should provide information on both the existing stormwater management system, including any impacts to the system, as well as proposed stormwater management. Again, this first phase of review is to determine project feasibility. 2. October 26, 2021 — Comment addressed; however, I would like to make you aware that the sidewalk width will likely need to be 10-ft. No change is required at this time. Any adjustments to the width can occur at the building permit phase of the project. 5/12/2021 comment - Edmonds Community Development Code requires a specific pedestrian area layout for CG Zoned properties in accordance with ECDC 16.60.020. Please revise plans to clearly show the specific zones that are required: 5' min. Streetscape Zone, 7'-10' Pedestrian Zone, 18"-2' min Activity Zone 3. Comment addressed. 5/12/2021 comment - If the public sidewalk is proposed to cross over private property, a public pedestrian easement will be required. Please note as such on the plans. 4. October 26, 2021 — Partially addressed. Plans do indicate new street light poles. For consistency with previous email communications, please add note to plans that the two existing street light poles will need to be removed and replaced to meet Highway 99 corridor district lighting standards. 5/12/2021 comment - Street light posts are to be located in the Streetscape Zone. 5.
